THE KERALA BEEDI AND CIGAR WORKERS' WELFARE FUND ACT, 1995 [1] THE KERALA BEEDI AND CIGAR WORKERS' WELFARE FUND ACT, 1995 [1] (ACT 18 OF 1995) An Act to provide for the constitution of a fund to grant relief to, promote the welfare of, and to pay pension to beedi and cigar workers and self-employed persons in beedi and cigar industries in the State of Kerala. Preamble. "WHEREAS it is expedient to provide for the constitution of a fund to grant relief to, to promote the welfare of and to pay pension to beedi and cigar workers and self-employed persons in beedi and cigar industries in the State of Kerala and matters connected therewith or incidental thereto; BE it enacted in the Forty-sixth Year of the Republic of India as follows: " 1. Short title, extent and commencement. "(1) This Act may be called the Kerala Beedi and Cigar Workers' Welfare Fund Act, 1995. (2) It extends to the whole of the State of Kerala. (3) It shall come into force on such date as the Government may, by notification in the Gazette, appoint. 2. Definitions."(1) In this Act, unless the context otherwise requires," (a) 'Board' means the Kerala Beedi and Cigar Workers'.....

Section 4 - Amendment of section 15 In section 15 of the principal Act,-- (i) in sub-section (5), for the words one hundred rupees and two hundred rupees, the words two hundred and fifty rupees and five hundred rupees shall, respectively, be substituted; (ii) to sub-section (5), the following proviso shall be added, namely:-- Provided that an advocate designated as senior Advocate under the Advocates Act, 1961 (Central Act 25 of 1961) shall pay an annual subscription to the Fund at the rate of one thousand and five hundred rupees before the 30th June of every year; (iii) sub-section (6) shall be omitted; (iv) for sub-sections (7) and (8), the following sub-sections shall be substituted, namely:-- (7) A member who fails to remit the annual subscription for a year on or before the 30th June of that year may,.....

(1) The shall be constituted a Fund to be called the Fund for Technology Development and Application and there shall be credited to the Fund- (a) any grants and loans made to the Board by the Central Government under section 8; (b) all sums received by the Board from any other source; (c) recoveries made of the amounts granted from the Fund; and (d) any income from investment of the amount of the Fund. (2) The Fund shall be applied for meeting- (a) expenses on the object and for the purposes authorised by this Act; (b) salaries, allowances and other expenses of officers and other employees of the Board; and (c) expenses of the Board in the discharge of its functions under this Act.

(1) All moneys received or realised by the Board under this Act and all other moneys received as donations, benefactions or grants by the Board shall form a find to be called the Wakf Fund. (2) All moneys received by the Board, as donations, benefactions and grants shall be deposited and accounted for under a separate sub-head. (3) Subject to any rules that may be made by the State Government in this behalf, the Wakf Fund shall be under the control of the Board, so, however, that the Wakf Fund under the control of common Wakf Board shall be subject to rules, if any, made in this behalf by the Central Government. (4) The Wakf Fund shall be applied to (a) repayment of any loan incurred under section 75 and payment of interest thereon; (b) payment of the cost of audit of the Wakf Fund and the accounts of wakfs; (c) payment of the salary and allowances to the Officers and staff of the Board; (d) payment of travelling allowances to the Chairperson, members, of the Board; (e) payment of all expenses incurred by the Board in the performance of the duties imposed, and the exercise of the powers conferred, by or under this Act; (f) payment of all expenses incurred by.....

(1) Where the owner of a textile undertaking has established a provident fund, superannuation, welfare or other fund for the benefit of the persons employed in such textile undertaking the monies relatable to the employees, whose services have become transferred by or under this Act to the National Textile Corporation shall, out of the monies standing, on the appointed day, to the credit of such provident fund, superannuation, welfare or other fund, stand transferred to, and shall vest in, the National Textile Corporation. (2) The monies which stand transferred, under sub-section (1), to the National Textile Corporation shall be dealt with by that Corporation in such manner as may be prescribed.

For the purpose of making provisions for the payment of rent and of revenue, cess, rales and taxes due to the Government or any local authority, for the discharge of the expenses of the repair of the wakf property and for the preservation of the wakf property, the Board may direct the creation and maintenance, in such manner as it may think fit, of a reserve fund from the income of a wakf.
