Title: Power of Companies to Make Donations to Certain National Funds

Any company may, notwithstanding anything contained in the Companies Act or in any other law for the time being in force regulating the affairs thereof, and notwithstanding that the memorandum or articles of association of the company do not enable it so to do, by an extraordinary resolution passed in accordance with the provisions contained in section 81 of the Companies Act, authorise the making of donations to the Gandhi National Memorial Fund or the Sardar Vallabhabhai National Memorial Fund, or to any other Fund established for a charitable purpose which by reason of its national importance has been approved by the Central Government for the purposes of this section.

.....to the donation, any part of the income of the institution or fund has become chargeable to tax due to non-compliance with any of the provisions of section 11, section 12 or section 12A ; (ii) that, under clause (c) of sub-section (1) of section 13, the exemption under section 11 or section 12 is denied to the institution or fund in relation to any income arising to it from any investment referred to in clause (h) of sub-section (2) of section 13 where the aggregate of the funds invested by it in a concern referred to in the said clause (h) does not exceed five per cent of the capital of that concern. Explanation 3 : In this section, charitable purpose does not include any purpose the whole or substantially the whole of which is of a religious nature. 34[Explanation 4 : For the purposes of this section, an association or institution having as its object the control, supervision, regulation or encouragement in India of such games or sports as the Central Government may, by notification in the Official Gazette, specify in this behalf, shall be deemed to be an institution established in India for a charitable purpose.] Explanation 5 : For the removal of doubts, it is hereby.....

[ 2nd May 1953 ] An Act to authorise the use of contributions or donations made by local authorities to the Gandhi Memorial Fund outside the limits of such local authorities WHEREAS it is expedient to make provisions for authorising use of the contributions or donations made by local authorities in the State of Bombay to the fund known as the Gandhi National Memorial Fund, outside the limits of such loc al authorities; It is hereby enacted as follows :- 1. Short title:- This Act may be called the Gandhi National Memorial Fund (Local Authorities' Donations) Act, 1953. 2. Definitions:- In this Act unless there is anything repugnant to the subject or context,- (1) "the Gandhi National Memorial Fund" means the fund known as the Gandhi National Memorial Fund started under the auspices of the President of the Indian National Congress; (2) "local authority" means a municipal corporation.....

Title: Donations or Subscription Byproducer Company

(1) A Producer Company may, by special resolution, make donation or subscription to any institution or individual for the purposes of (a) promoting the social and economic welfare of Producer Members or producers or general public; or (b) promoting the mutual assistance principles: Provided that the aggregate amount of all such donation and subscription in any financial year shall not exceed three per cent. of the net profit of the Producer Company in the financial year immediately preceding the financial year in which the donation or subscription was made: Provided further that no Producer Company shall make directly or indirectly to any political party or for any political purpose to any person any contribution or subscription or make available any facilities including personnel or material.
