.....1947, was in force) (3) In the areas in which the Bombay Industrial Disputes Act, 1938, was in force immediately before the commencement of this Act, this Act shall apply to the industries to which the said Act applied 6[Provided that this Act shall cease to apply with effect from the date on which the Bombay Industrial Relations (Amendment) Act, 1949, comes into force, to the Imperial Bank of India and any banking company as defined in section 5 of the Banking Companies Act, 1949, having branches or other establishments in more than one 4[State] (4) The 4[State Government may by notification in the Official Gazette apply all or any of the provisions of this Act to all or any other industries, whether generally or any local area as may be specified in such notification. Power of Industrial Court to transfer proceedings The Industrial Court may, by order in writing and for reasons to be stated therein, withdraw any proceeding under this Act pending before a Court and transfer the same to another Labour Court for the disposal of the proceeding; and the Labour Court to which the proceeding is so transferred may dispose of the proceeding but subject to any special directions in the order of transfer, proceed either de novo or from the stage at which it was so transferred.] _____________________ 1. .....other property, whether moveable or immoveable, and includes a wholesale or retail merchant, a commission agent, - a broker, a manufacturer, a contractor, a factory owner, but does not include an artisan or a person who sells his agricultural produce or cattle or buys agricultural produce or cattle, for his use. Explanation."For the purposes of this clause an "artisan" means a person who does not employ more than ten workers in a manufacturing process on any one day of the twelve months immediately preceding. NOTES: (A) Changes made by the new amendment in two of the definitions have created disturbance in business community and especially the money-lenders who were advancing loans to traders. (B) Definition of word LOAN in sub-section 2 has been amended by addition of words WHETHER IN CASH OR KIND AND after the words ADVANCING LOANS. These words appear to have been added to clarify the word loan as to include the advance in kind like grains advanced with condition to return one and half times after harvest. The definition of word LOAN in sub section (9) even prior to the amendment states that the loan meant an advance whether of money or in kind. Thus this particular amendment.....

.....rendered by an Electric Inspector or any other officer appointed to assist the Electric Inspector under the provisions of the Indian Electricity Act, 1910, or any rules made thereunder within ten days from the date of the presentation of the bill for such inspection, examination, test or rendering of service, the 27 [State] Government or any other officer authorized by the 27 [State] Government in that behalf may, notwithstanding anything contained in the Indian Electricity Act, 1910., or the terms of any licence or sanction granted thereunder or any agreement for the supply of electrical energy, by order in writing direct the licensee, without prejudice to any other right to recover such fees, to discontinue the supply of electrical energy to such consumer and the licensee shall thereupon discontinue the supply of electrical energy to such consumer. (2) On payment of such fees by the consumer, the 26[State] Government or the authorized officer may by order in writing direct the licensee to reconnect and commence the supply of electrical energy, and the licensee shall thereupon connect and recommence the supply to consumer as soon as practicable: Provided that the licensee.....

Title: Penalty for Molestation

Title: Contempt of Industrial Court, Labour Courts and Wage Board Relating to Omission to Produce Documents Etc.

(3) If any offence under sub-section (1) or (2) is committed in the view or presence of the Industrial Court or a Labour Court or a Wage Board, as the case may be, such Court or Wage Board may, after recording the facts constituting the offence and the statement of the accused as provided in3[the Code of Criminal Procedure, 1973 (II of 1974),] forward the case to a magistrate having jurisdiction to try the same and may require security to be given, for the appearance of the accused person before such magistrate or, if sufficient security is not given shall forward such person in custody to such magistrate. The magistrate to whom any case is so forwarded shall proceed to hear the complaint against the accused person in the manner provided in the said Code of Criminal Procedure. __________________________ 1. .....employed in the Mica mining industry. Section 6of the Act empowers he Central Government to make rules to carry into effect the purposes of the Act. The Act does not require the rules made by the Central Government to be laid before Parliament. 2. The Committee on Subordinate Legislation (Fifth Lok Sabha) in their fourteenth Report desired that the Government should undertake a review of all Acts to find out which of them do not contain a provision for laying of rules tramed thereunder before Parliament and should incorporate such provision in those Acts. The committee on Subordinate Legislation (Sixth Lok Sabha) in their Nineteenth Report further desired that the necessary mending legislation be brought up at an early date. It is proposed to accept these recommendations of the Committees on Subordinate Legislation and make a suitable amendment in the Mica Mines 1. Labour Welfare Fund Act. 1946. The ill seeks to achieve tins object. Gaz of India. 26-3-1980. Pt. II. S. 2. Ext.. p. 324. An Act to constitute a fund for the financing of activities to promote the welfare of labour employed in the mica mining industry. WHFRFAS it is expedient to constitute a fund for the financing.....

.....regard to the interest of the person immediately concerned and of the community as a whole; (19) "industry" means- (a) any business, trade, manufacture or undertaking or calling of employers; (b) any calling, service, employment, handicraft, or industrial occupation or avocation of employees; and includes (i) agriculture and agricultural operations; (ii) any branch of an industry or group of industries which the14 [State] Government may by notification in the Official Gazette declare to be an industry for the purposes of this Act; (20) "Joint Committee" means a Joint Committee constituted under section 48; (21) "Labour Court" means a Labour Court constituted under section 9; (22) "Labour Officer" means an Officer appointed to perform the duties of a Labour Officer under this Act; and includes in respect of such powers and duties of the Labour Officer as may be conferred and imposed on him, an Assistant Labour Officer; (23) "local area" means any area15 [(including the entire State)] notified as a local area for the purposes of this Act16 [or for different industries;] (24) "lock-out" means the closing of a place or part of a place of employment or the total.....

Title: Liability of the Executive of a Union

Where anything is required to be done by any union under this Act, the person authorised in this behalf by the executive of the union, and where no person is so authorised every member of the executive of the union, shall be bound to do the same and shall be personally liable if default is made in the doing of any such thing. Explanation.-For the purposes of this section, the executive of a union means the body by whatever name called to which the management of the affairs of the union is entrusted.
