.....times, first executed; (5) "Chief Controlling Revenue Authority"means the officer appointed under sub-section (1) of Section 3 of the Registration Act, 1908 (Central Act XVI of 1908) to be the Inspector General of Registration or any person authorised by the Government to exercise all or any of the power of the Chief Controlling Revenue Authority under that Act; (6) "clearance list"means a list of transactions relating to contracts required to be submitted to the Clearing House of an association in accordance with the rules or bye-laws of the association; (7) "Collector"means the Collector of a district and includes any officer specifically appointed by the Government to perform the functions of the Collector under this Act; (8) "conveyance" includes" (a) a conveyance on sale; (b) every instrument; (c) every order made by the High Court under Section 394 of the Companies Act, 1956 (Central Act 1 of 1956) in respect of amalgamation or reconstruction of companies; and (d) every order made by the Reserve Bank of India under Section 44A of the Banking Regulation Act, 1949; by which property, whether movable or immovable or any interest in any property is transferred inter vivos and.....

THE KERALA ADVOCATES' CLERKS WELFARE FUND ACT, 2003 [1] ACT 27 OF 2003 THE KERALA ADVOCATES' CLERKS WELFARE FUND ACT, 2003 [1] An Act to provide for the constitution of a Welfare Fund for the Benefit of Advocates' Clerks in the State of Kerala and for matters connected therewith or incidental thereto . Preamble.--WHEREAS it is expedient to provide for the constitution of a Welfare Fund for payment of retirement and other benefits to Advocates' Clerks in the State of Kerala and for matters connected therewith or incidental thereto; BE it enacted in the Fifty-fourth year of the Republic of India as follows:- 1. Short title and commencement.--(1) This Act may be called the Kerala Advocates' Clerks Welfare Fund Act, 2003. (2) It shall come into force on such date as the Government may, by notification in the Gazette, appoint. 2. Definitions.--In this Act, unless the context otherwise requires,- (a) "Advocate" means a person whose name has been entered in the State Roll of Advocates, prepared and maintained by the Bar Council of Kerala under section 17 of the Advocates Act, 1961 (Central Act 25 of 1961) and practising as an Advocate, whether he is a member.....

I/We further declare that no transaction for which an exemption is claimed under Article 5 or Article 36 in Schedule to the Rajasthan Stamp Act, 1998, as the case may be, is omitted." Every application by a divorced woman under Section 125 or under section 127 of the Code of Criminal Procedure, 1973 (2 of 1974), pending before a Magistrate or the commencement of this Act, shall, notwithstanding anything contained in that Code and subject to the provisions of section 5 of this Act, be disposed of by such Magistrate in accordance with the provisions of this Act.

Title: Option to Be Governed by the Provisions of Section 125 to 128 of Act 2 of 1974

If, on the date of the first hearing of the application under sub-section (2) of section 3, a divorced woman and her former husband declare, by affidavit or any other declaration in writing in such form as may be prescribed, either jointly or separately, that they would prefer to be governed by the provisions of Sections 125 to 128 of the Code of Criminal Procedure, 1973 (2 of 1974); and file such affidavit or declaration in the Court hearing the application, the Magistrate shall dispose of such application accordingly. Explanation.-- For the purposes of this section, "date of the first hearing of the application" means the date fixed in the summons for the attendance of the respondent to the application.

Muslim Women (Protection of Rights on Divorce) Act, 1986 Section 4

Title: Order for Payment of Maintenance

.....a divorced woman is unable to maintain herself and she has no relative as mentioned in sub-section (1) or such relatives or any one of them have not enough means to pay the maintenance ordered by the Magistrate or the other relatives have not the means to pay the shares of those relatives whose shares have been ordered by the Magistrate to be paid by such other relatives under the proviso to sub-section (1), the Magistrate may, by order direct the State Wakf Board established under section 9 of the Wakf Act, (29 of 1954), or under any other law for the time being in force in a State, functioning in the area in which the woman resides, to pay such maintenance as determined by him under sub-section (1) or, as the case may be, to pay the shares of such of the relatives who are unable to pay, at such periods as he may specify in his order.
