Title: Dividing Business

.....is undertaken by the society. 4 [(3) Where after the commencement of the Insurance (Amendment) Act, 1941, a provident society is to be wound up in pursuance of this section, or where, whether before or after the commencement of that Act, a provident society ceases to carry on business on the dividing principle, the provisions of sub-section (2) and sub-section (3) of section 52 shall, so far as may be, apply in like manner as they to an insurer ceasing to carry on business on the dividing principle.] _________________________ 1. Indian Treasure Trove Act, 1878 Section 12

Title: When Only One Such Person Claims and His Claim is Not Disputed, Treasure to Be Divided

.....ma fix as the equivalent of the share of such other party, o of the excess so allotted. as the case may be; or (b) sell such treasure or any portion thereof by public auction and divide the sale-proceeds between the parties according to the rule hereinbefore prescribed: Provided also, that when the Collector has by his declaration uncle section 9 rejected any claim made under this Act by any person of the. than the said finder or person claiming as owner of the place in which the treasure was found, such division shall not be made until after the expiration of two months without an appeal having been presented under section 9 by the person whose claim has been so rejected, or, when an appeal has been so presented, after such appeal has been dismissed. When the Collector has made a division under this section, he shall to deliver to the parties the portions of such treasure, or the money in de lieu thereof, to which they are respectively entitled under such to division.

Karnataka Treasure Trove Act, 1962 Section 11

.....of the State Government, and subject to its instructions, if any, sell such treasure or any portion thereof by public auction and divide the sale proceeds between the parties according to clause (a) or (b), as the case may be: Provided further that when the Deputy Commissioner has made a declaration under section 8, a division under this sub-section shall not be made until after the expiration of sixty days from the date of such declaration or when an appeal against such declaration is preferred under sub-section (3) of section 8 after such appeal has been dismissed, whichever is later. (2) When the Deputy Commissioner has made a division under sub-section (1), he shall deliver to the parties the portions of such treasure or the money in lieu thereof, to which they are respectively entitled under such division.

It shall be lawful for the Secretary of State to divide the Council into Committees for the more convenient Transaction of Business, and from Time to Time to re-arrange such Committees, and to direct what Departments of the Business in relation to the Government of India under this Act shall be under such Committees respectively, and generally to direct the Manner in which all such business shall be transacted.

Code of Criminal Procedure, 1973 Section 392

Title: Procedure Where Judges of Court of Appeal Are Equally Divided

When an appeal under this Chapter is heard by a High Court before a Bench of Judges and they are divided in opinion, the appeal, with their opinions, shall be laid before another Judge of that Court, and that Judge, after such hearing as he thinks fit, shall deliver his opinion, and the judgment or order shall follow that opinion: Provided that if one of the Judges constituting the Bench, or, where the appeal is laid before another Judge under this section, that Judge, so requires, the appeal shall be re-­heard and decided by a larger Bench of Judges.

Co-operative Societies Act, 1912 Section 33

Title: Funds Not to Be Divided by Way of Profit

No part of the funds of a registered society shall be divided by way of bonus or dividend or otherwise among its members: Provided that after at least one-fourth of the net profits in any year have been carried to a reserve fund, payments from the remainder of such profits and from any profits of past years available for distribution may be made among the members to such extent and under such conditions as may be prescribed by the rules or by-laws: Provided also that in the case of a society with unlimited liability no distribution of profits shall be made without the general or special order of the1[State Government] in this behalf. _____________________ 1. Multi State Co-operative Societies Act, 1984 [Repealed] Section 60

Title: Funds Not to Be Divided by Way of Profit

.....working expenses including repairs, rent, taxes and depreciation, bonus payable to employees under the law relating to payment of bonus for the time being in force, and equalization fund for such bonus, provision for payment of income-tax and making approved donations under the Income-tax Act, 1961, development rebate, provision for development fund, bad debts fund, price fluctuation fund, dividend equalization fund, share capital redemption fund, investment fluctuation fund, provision for retirement benefits to employees, and after providing for or writing off bad debts and losses not adjusted against any fund created out of profit : Provided that such society may. add to the net profits for the year, interest accrued in the preceding years, but actually recovered during the year : Provided further that in case of such multi-State co-operative societies as do not have share capital, the surplus of income over expenditure shall not be treated as net profits and such surplus shall be dealt with in accordance with the bye-laws.

Title: Presidency of Fort William in Bengal to Be Divided into Two Presidencies

* * *1the territories now subject to the government of the presidency of Fort William in Bengal shall be divided into two distinct presidencies, one of such presidencies in which shall be included Fort William aforesaid, to be styled the Presidency of Fort William in Bengal, and the other of such presidencies to be styled the Presidency of Agra; The court of directors to declare the limits from time to time of the several presidencies.--And it shall be lawful for the said court of directors under the control by this Act provided, and they are hereby required to declare and appoint what part or parts of any of the territories under the government of the said company shall from time to time be subject to the government of each of the several presidencies now subsisting or to be established as aforesaid, and from time to time, as occasion may require, to revoke and alter, in the whole or in part, such appointment, and such new distribution of the same as shall be deemed expedient. ____________________________ 1.
