THE KARNATAKA OPEN PLACES (PREVENTION OF DISFIGUREMENT) ACT, 1981 [ACT No. 35 OF 1982] [28th August, 1982] PREAMBLE An Act to prevent disfigurement, by unauthorised advertisements of places open to public view in the State of Karnataka. WHEREAS it is expedient to prevent disfigurement, by unauthorised advertisements of places open to public view in the State of Karnataka. BE it enacted by the Karnataka State Legislature in the Thirty--second year of the Republic of India as follows:--

.....Act 8 of 1994) [(dd) "State Transport Undertaking" means a State Transport Undertaking as defined in clause (42) of Section 2 of the Motor Vehicles Act 1988 (Central Act 59 of 1988)] (Inserted by Tamil Nadu Act 39 of 1986) (e) "Traffic Committee" means a Traffic Committee constituted under Section 3-B and having jurisdiction. 3. Penalty for disfigurement by objectionable advertisements. " Whoever affixes to, or inscribes or exhibits on, any place open to public view any objectionable advertisement of either description for a term which may extend to one year or with fine which may extend to ( Substituted by Tamil Nadu Act 55 of 1992 ) [five thousand rupees] or with both. (Inserted by Tamil Nadu Act 39 of 1986) [3 -A . Penalty for disfigurement by certain categories of unauthorised advertisements without permission. " (1) (Ibid) [Subject to the provisions of Section 4-A, and without prejudice to the provisions of section 4,] whoever, without the previous permission of the Traffic Committee, affixes to, or inscribes or exhibits on, any place open to public view any advertisement which " (a) obstructs the line of vision of any person or the driver of any vehicle using.....

Whoever, without due authority, affixes any placard, advertisement, notice, list, document board or other thing in or on, or paints, tars or in any way disfigures any post office or any letter-box provided by the Post Office for the reception of postal articles, shall be punishable with fine which may extend to fifty rupees.

Title: Short Title and Commencement

State: Karnataka

(1) This Act may be called the Karnataka Open Places (Prevention of Disfigurement) Act, 1981. (2) It shall,-- (i) be deemed to have come into force in the cities of Bangalore, Mysore, Hubli--Dharwar, Mangalore and Belgaum constituted or continued under the Karnataka Municipal Corporations Act, 1976 or under any other law, on the fifth day of May 1981; and (ii) come into force in the municipalities, notified areas, sanitary boards, constituted or continued under the Karnataka Municipalities Act, 1964 or under any other law, or in any other local area, on such date, as the State Government may by notification, appoint and different dates may be appointed in respect of different areas.

Title: Penalty for Unauthorised Disfigurement by Advertisement

.....therein or to any sale, entertainment or meeting to be held on or upon or in the same; or (iii) relates to the name of the land or building, upon or over which the advertisement is exhibited, or to name of the owner or occupier of such land or building ; or (iv) relates to the business of a railway administration and is exhibited within any railway station or upon any wall or other property of a railway administration. 1[(v) is affixed to or exhibited on any ancient and historical monument declared to be of national importance under the Ancient Monuments and Archaeological Sites and Remains Act, 1958 ( Central Act XXIV of 1958).]1 ______________________________________ 1. Title: Repeal and Savings

State: Karnataka

(1) The Karnataka Open Places (Prevention of Disfigurement) Ordinance, 1981 ( Karnataka Ordinance 10 of 1981) is hereby repealed. (2) Notwithstanding such repeal anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under this Act.

The Indian Penal Code 1860 Complete Act

.....1908, `India', means the territory of India excluding the State of Jammu and Kashmir. Under s. 2(e) of the Monopolies and Restrictive Trade Practices Act, 1969, `India' means for the purposes of this Act the territories to which this Act extends (i.e., whole of India except the State of Jammu and Kashmir). Illustrations (a) A Collector exercising jurisdiction in a suit under Act 10 of 1859, is a Judge. (b) A Magistrate exercising jurisdiction in respect of a charge on which he has power to sentence to fine or imprisonment, with or without appeal, is a Judge. (c) A member of a Panchayat which has power.....

The Criminal Law (Amendment) Act, 2013 Complete Act

.....of an offence punishable under section 376B of the Indian Penal Code where the persons are in a marital relationship, except upon prima facie satisfaction of the facts which constitute the offence upon a complaint having been filed or made by the wife against the husband." 20. In section 273 of the Code of Criminal Procedure, before the Explanation, the following proviso shall be inserted, namely:- "Provided that where the evidence of a woman below the age of eighteen years who is alleged to have been subjected to rape or any other sexual offence, is to be recorded, the court may take appropriate measures to ensure that such woman is not confronted by the accused while at the same time ensuring the right of cross-examination of the accused." 21. In section 309 of the Code of Criminal Procedure, for sub-section (1), the following sub-section shall be substituted, namely:- "(1) In every inquiry or trial the proceedings shall be continued from day-to-day until all the witnesses in attendance have been examined, unless the Court finds the adjournment of the same beyond the following day to be necessary for reasons to be recorded: Provided that when the inquiry or trial.....
