Title: Confirming of Findings and Sentences on Board a Ship

When any person subject to this Act is tried and sentenced by a Force Court while on board a ship, the finding and sentence so far as not confirmed and executed on board the ship, may be confirmed and executed in like manner as if such person had been tried at the port of disembarkation.

Sashastra Seema Bal Act 2007 Chapter IX

Title: Confirmation and Revision of Proceedings

.....finding could have been validly made by the Force Court on the charge and unless it appears that the Force Court must have been satisfied of the facts establishing the said offence. (2) Where a sentence passed by a Force Court which has been confirmed, or which does not require confirmation, not being a sentence passed in (sic) of a new finding substituted under sub-section (1), is found for any reason to be invalid, the authority referred to in sub-section (1) may pass a valid sentence. (3) The punishment awarded by a sentence passed under sub-section (1) or subsection (2) shall not be higher in the scale of punishments than, or in excess of, the punishment awarded by, the sentence for which a new sentence is substituted under this section. (4) Any finding substituted, or any sentence passed, under this section shall, for the purposes of this Act and the rules, have effect as if it were a finding or sentence, as the case may be, of a Force Court. Assam Rifles Act, 2006 Chapter X

Merchant Shipping (Amendment) Act, 2002 Chapter 2

Title: Amendment of the Merchant Shipping Act, 1958

Section 18 - Substitution of new section for section 352B For section 352B of the principal Act, the following section shall be substituted, namely:- "352B. Limitation of liability. Merchant Shipping (Amendment) Act, 2002 Section 20

Title: Amendment of Section 352d

In section 352D of the principal Act,- (i) in sub-section (5), for clause (a), the following clause shall be substituted, namely:- '(a) "Convention country" means a country in which the Convention on Limitation of Liability for Maritime Claims, 1976 as amended from time to time is for the time being in force;'; (ii) after sub-section (5), the following sub-sections shall be inserted, namely: "(6) Notwithstanding anything contained in sub-sections (1) to (4), the vessels or other property referred to in sub-section (1) shall be ordered to be released if the limitation Fund has been constituted,- (a) in the port where the occurrence took place, or, if it took place out of port, in the first port of call thereafter; (b) in the port of disembarkation in respect of claims for loss of life or personal injury; or (c) in the port of discharge in respect of damage to cargo. (7) The provision of sub-section (6) shall apply only if the claimant brings a claim against the limitation Fund before the High Court administering the Fund and the Fund is actually available and freely transferable in respect of that claim.".
