The Bombay Village Police (Appointments and Disciplinary Action by Subdivisional Magistrates, Validation) Act, 1967 Complete Act

.....1867, as amended by this Act. And accordingly, notwithstanding anything in any judgment, decree or order of any Court, any such appointment, disciplinary action or order shall be deemed to have been validly made or taken; and any such appointment, disciplinary action or order or anything done by the Police-patels in the exercise of their powers by or under the Bombay Village Police Act, 1867 or any other law for the time being in force shall not be called in question (or if questioned shall not be maintained) in any Court or before any Tribunal or authority merely on the ground that the Magistrate had no power to make the appointment or to take an action, or that the State Government or the Commissioner had no power to interfere in the matter, or had not exercised its or his powers for such interference by or under some other provision of that Act or that the Police-patel was not properly appointed, nor on any ground consequential to the grounds aforesaid. SECTION 04: REPEAL OF MAH. ORD. II OF 1967 The Bombay Village Police (Appointments and Disciplinary Action by Sub-Divisional Magistrates, Validation) Ordinance, 1967, is hereby repealed. .....shall be invalid merely by reason of the absence of the Chairman or member thereof on any such date: Provided that no final orders of the nature referred to in sub-section (3) of Section 35 can be made in any proceedings unless the Chairman and other members of the disciplinary committee are present. (5) Where no final order of the nature referred to in sub-section (3) of section 35 can be made in any proceedings in accordance with the opinion of the Chairman and the members of a disciplinay committee either for want of majority opinion amongst themselves or otherwise, the case, with their opinion thereon, shall be laid before the Chairman of the Bar Council concerned or if the Chairman of the Bar Council is acting as the Chairman or a member of the disciplinary committee, before the Vice-Chairman of the Bar Council, and the said Chairman or the Vice-Chairman of the Bar Council, as the case may be after such hearing as he think fit, shall deliver his opinion and the final order of the disciplinary committee shall follow such opinion. ] _______________________ 1. Powers of Inquiring Officer and penalty for disobedience to process- (1) Any Inquiring Officer shall have the same powers in the matter of summoning of witnesses and compelling the production of documents as are conferred upon the Commissioner under Section 8 of the Public Servants (Inquiries) Act, 1850 (Act XXXVII of 1850): Provided that all process to cause the attendance of witnesses or production of documents or other compulsory process shall be served through and executed by the District Magistrate or the Sub-divisional Magistrate, as the case may be, in whose jurisdiction the witness or other person resides and on whom such process is to be served. ( 2 ) The provisions of Section 9 of the said Act providing for penalty for disobedience to process shall apply to any process issued by an Inquiring Officer as they apply to such process issued by the Commissioners aforesaid. 5. .....this section, shall observe, so far as may be, the procedure laid down in section 35, the references to the Advocate- General in that section being construed as references to the Attorney- General of India. SECTION 02: DEFINITIONS -In this Act,- (a) "Authority" means the Delhi Development Authority established underSection 3 of the Delhi Development Act, 1957 (61 of 1957); (b) "Vice-Chairman" means the Vice-Chairman of the Authority.
