Title: Power to Give Effect to Orders, Directions, Etc

(1) Any authority empowered by or under or in pursuance of the provisions of this Act to give any direction or to exercise any other power, may, in addition to any other action expressly provided for in this Act, take, or cause to be taken such steps and use, or cause to be used, such force as may, in its opinion, be reasonably, necessary for securing compliance with such direction or for preventing or rectifying any breach thereof, or for the effective exercise of such power, as the case may be. (2) Any police officer may take such steps and use such force as may, in his opinion, be reasonably necessary for securing compliance with any order made or direction given under or in pursuance of the provisions of this Act or for preventing or rectifying any breach of such order or direction. (3) The power conferred by this section shall be deemed to confer upon any person acting in exercise thereof a right of access to any land or other property whatsoever.

Title: Power of Court to Direct Payment of Decretal Amount by Instalments

Notwithstanding anything contained in the Code of Civil Procedure, 1908 (V of 1908), the Court, may at any time, on application of a judgement-debtor, after notice to the decree-holder, direct that the amount of any decree passed against him, whether before or after the date on which this Act comes into force, in respect of a loan, shall be paid in such number of instalments and subject to such conditions, and payable on such dates, as, having regard to the circumstances of the judgment-debtor and the amount of the decree, it considers fit.

.....AND REASONS "At present the only permanent measures governing foreigners specifically are the Registration of Foreigners Act ,1939andthe Foreigners Act, 1864. The Act of 1939 provides for the making of rules to regulate registration of foreigners and formalities connected therewith, their movement in, or departure from, India. The Act of 1864 provides for the expulsion of foreigners and their apprehension and detention pending removal and for a ban on their entry into India after removal; the rest of the Act which provides for report on arrival, travel under a licence and certain incidental measures can be enforced only on the declaration of an emergency. The powers under this Act have been found to be ineffective and inadequate both during normal times and during an emergency. The needs of the war emergency were met by the enactment of a Foreigners Ordinance in 1939 and the promulgation under it of the Foreigners Order and the Enemy Foreigners Order. Even at that time the need for more satisfactory permanent legislation was recognised but it was decided to postpone consideration of such a measure until after the war. The Ordinance was. therefore, replaced by the Foreigners Act,.....

.....rendered by an Electric Inspector or any other officer appointed to assist the Electric Inspector under the provisions of the Indian Electricity Act, 1910, or any rules made thereunder within ten days from the date of the presentation of the bill for such inspection, examination, test or rendering of service, the 27 [State] Government or any other officer authorized by the 27 [State] Government in that behalf may, notwithstanding anything contained in the Indian Electricity Act, 1910., or the terms of any licence or sanction granted thereunder or any agreement for the supply of electrical energy, by order in writing direct the licensee, without prejudice to any other right to recover such fees, to discontinue the supply of electrical energy to such consumer and the licensee shall thereupon discontinue the supply of electrical energy to such consumer. (2) On payment of such fees by the consumer, the 26[State] Government or the authorized officer may by order in writing direct the licensee to reconnect and commence the supply of electrical energy, and the licensee shall thereupon connect and recommence the supply to consumer as soon as practicable: Provided that the licensee.....

Mica Mines Labour Welfare Fund Act, 1946 Complete Act

.....employed in the Mica mining industry. Section 6of the Act empowers he Central Government to make rules to carry into effect the purposes of the Act. The Act does not require the rules made by the Central Government to be laid before Parliament. 2. The Committee on Subordinate Legislation (Fifth Lok Sabha) in their fourteenth Report desired that the Government should undertake a review of all Acts to find out which of them do not contain a provision for laying of rules tramed thereunder before Parliament and should incorporate such provision in those Acts. The committee on Subordinate Legislation (Sixth Lok Sabha) in their Nineteenth Report further desired that the necessary mending legislation be brought up at an early date. It is proposed to accept these recommendations of the Committees on Subordinate Legislation and make a suitable amendment in the Mica Mines 1. Labour Welfare Fund Act. 1946. The Bombay Money Lenders Act, 1946 Complete Act

.....other property, whether moveable or immoveable, and includes a wholesale or retail merchant, a commission agent, - a broker, a manufacturer, a contractor, a factory owner, but does not include an artisan or a person who sells his agricultural produce or cattle or buys agricultural produce or cattle, for his use. Explanation."For the purposes of this clause an "artisan" means a person who does not employ more than ten workers in a manufacturing process on any one day of the twelve months immediately preceding. NOTES: (A) Changes made by the new amendment in two of the definitions have created disturbance in business community and especially the money-lenders who were advancing loans to traders. (B) Definition of word LOAN in sub-section 2 has been amended by addition of words WHETHER IN CASH OR KIND AND after the words ADVANCING LOANS. These words appear to have been added to clarify the word loan as to include the advance in kind like grains advanced with condition to return one and half times after harvest. The definition of word LOAN in sub section (9) even prior to the amendment states that the loan meant an advance whether of money or in kind. Thus this particular amendment.....

Title: Power to Control Places Frequented by Foreigners

.....has been given under sub-section (1) shall not, while such direction remain in force, use or permit to be used any other premises for any of the aforesaid purposes, except with the previous permission in writing of the prescribed authority and in accordance with any conditions which that authority may think fit to impose. (3) Any person to whom any direction has been given under sub-section (1) and who is aggrieved thereby may, within thirty days from the date of such direction, appeal to the Central Government; and the decision of the Central Government in the matter shall be final.] __________________________ 1. Industrial Employment (Standing Orders) Act, 1946 Complete Act

.....this Act for the time being applies, and includes- (i) in a factory, any person named under9[clause (f) of sub-section (1) of section 7 of the Factories Act, 1948 (63 of 1948)-], as manager of the factory; ( ii) in any industrial establishment under the control of any department of any Government in India, the authority appointed by such Government in this behalf, or where no authority is so appointed, the head of the department; (iii) in any other industrial establishment, any person responsible to the owner for the supervision and control of the industrial establishment; (e) "industrial establishment" means- ( i) an industrial establishment as defined in clause ( ii) of section 2 of the Payment of Wages Act, 1936-(4 of 1936), or 8[(ii) a factory as defined in clause (m) of section 2 of the Factories Act,1948-(63 of 1948), or] (iii) a railway as defined in clause (4) of section 2 of the Indian Railways Act, 1890(9 of 1890), or (iv) the establishment of a person who, for the purpose fulfilling a contract with the owner of any industrial establishment, employs workmen; (f) "prescribed" means prescribed by rules made by the appropriate Government under this Act; (g) "Standing.....
