THE TUNGA BHADRA SUGARS (DEVI SUGARS) LIMITED (ACQUISITION AND TRANSFER OF UNDERTAKING) (REPEAL) ACT, 2001 [Act, No. 25 of 2001] [29th August 2001] PREAMBLE An act to repeal the Tunga Bhadra Sugars (Deve Sugars) Limited (Acquisition and Transfer of Undertaking) Act, 1998. Whereas it is expedient to repeal the Tunga Bhadra Sugars (Deve Sugars) Limited (Acquisition and Transfer of Undertaking) Act, 1998 (Karnataka Act 1 of 1999) for the purpose hereinafter appearing; Be it enacted by the Karnataka State Legislature in the Fifty second year of the Republic of India, as follows:--

(2) In case of non-delivery of possession under Sub-section (1) Government may take necessary steps for securing possession of the movable properties,.....

.....cases, except where it appears that the object of granting injunction would be defeated by delay, before granting an injunction, give notice of the facts to the person concerned. (3) After hearing the person concerned and holding such inquiry, as he may think fit the Member-Secretary of the Board may confirm, discharge, very crest aside the order of injunction or pass an appropriate order. In the context in which clause (a) appears in section 2(5) and in view of the fact that there is a comma after the words "sites of buildings" we are of the view that the words "sites" in clause (a) does not qualify the words "other structures on such land" It should be interpreted as including other structures on such land as also sites of buildings.
