Requisitioning and Acquisition of Immovable Property Act, 1952 Complete Act

.....the Defence of India Act, 1939would continue to remain under requisition. Subsequently, the Requisitioning and Acquisition of Immovable Property Act, 1952 was enacted to confer-powers on the Government in this regard. Section 24of the Act provided .that any property which was subject to requisition under the Act of 1947 shall be deemed to have been requisitioned under the Requisitioning and Acquisition of Immovable Property Act, 1952. This Act was initially to remain in force for six years and was to expire on the 13th March, 1958. The life of the Act was however, extended from time to time, and will now remain in force up to the 13th March, 1970. 2. Chapter VI of the Defence of India Act, 1962provided for the requisitioning and acquisition of immovable property. The Act ceased to have effect with effect from the 10th July, 1968, namely six months after Proclamation of Emergency which was revoked with effect from the 10th January, 1968. As there were numerous properties requisitioned under the Defence of India Act, 1962, it was not found possible either to release them or to acquire them by the payment of compensation. Notaries Act, 1952 Complete Act

.....every State Government shall maintain, in such form as may be prescribed, a Register of the notaries appointed by that Government and entitled to practise as such under this Act. (2) Every such Register shall include the following particulars about the notary whose name is entered therein, namely :- (a) his full name, date of birth, residential and professional address; (b) the date on which his name is entered in the Register; (c) his qualifications; and (d) any other particulars which may be prescribed. Delhi and Ajmer Rent Control Act, 1952 [Repealed] Chapter VI

.....of which has been obtained by the landlord on the basis of any decree or order made on the grounds set forth in clause (e) of the proviso to sub-section (1) of section 13 or in respect of any premises which have been released from requisition for the use and occupation of the landlord himself. Delhi and Ajmer Rent Control Act, 1952 [Repealed] Section 46

.....to the said Act, shall be disposed of in accordance with the provisions of the said Act as if the said Act had continued in force and this Act had not been passed: Provided that the procedure laid down in this Act shall, as far as may be, apply to suits and other proceedings pending before any court. (3) Part IV of the Bombay Rents, Hotel Rates and Lodging House Rates (Control) Act, 1944 (Bombay Act VII of 1944) as extended to the Municipality of New Delhi, the Notified Area of the Civil Station, Delhi and the Municipality of Delhi by a notification of the Government of India in the late Department of Works, Mines and Power No.1884-W.II/47, dated the 18th March, 1947 shall cease to have effect in the said areas; and for the removal of doubts; it is hereby declared that section 6 of the General Clauses Act, 1897 (X of 1897) shall apply in relation to such cesser as it applies in relation to the repeal of an enactment by a Central Act.

BE it enacted by Parliament in the Twenty-eighth Year of the Republic of India as follows :-- 1.Short title This Act may be called the Presidential and Vice-Presidential Elections (Amendment) Act, 1977. 2.Substitution of new Part for Part III of Act 31 of 1952 In the Presidential and Vice-Presidential Elections Act, 1952, for Part III, the following Part shall be substituted, namely :-- PART III DISPUTES REGARDING ELECTIONS 13. Definitions.- In this Part, unless the context otherwise requires,-- (a) "candidate" means a person who has been or claims to have been duly nominated as a candidate at an election; (b) "costs" means all costs, charges and expenses of, or incidental to, a trial of an election petition; (c) "returned candidate" means a certificate whose name has been published under section 12 as duly elected. 14. Presidential and Vice-presidential Elections Act, 1952 Amending Act II

.....of 1952) (hereinafter referred to as the principal Act), in sub-section (1),- (i) in clause (a), for the words "ten electors" at both the places, where they occur, the words "fifty electors" shall be substituted; (ii) in clause (b), for the words "five electors" at both the places, where they occur, the words "twenty electors" shall be substituted. 3. Amendment of section 5C In section 5C of the principal Act, in sub-section (1), for the words "two thousand five hundred rupees", the words "fifteen thousand rupees" shall be substituted. 4.Repeal and saving (1) The Presidential and Vice-Presidential Elections (Amendment) Ordinance, 1997(Ord.13 of 1997), is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.
