Indian Easements Act, 1882 Section 18

Title: Customary Easements

An easement may be acquired in virtue of a local custom. Such easements are called customary easements. Illustrations (a) By the custom of a certain village every cultivator of village land is entitled, as such, to graze his cattle on the common pasture. A having become the tenant of a plot of uncultivated land in the village breaks up and cultivates that plot. He thereby acquire? an easement to graze his cattle in accordance with the custom. (b) By the custom of a certain town no owner or occupier of a house can open a new window therein so as substantially to invade his neighbour's privacy. A builds a house in the town near B's house. A thereupon acquires an easement that B shall not open new windows in his house so as to command a view of the portions of A's house which are ordinarily excluded from observation, and B acquires a like easement with respect to A's house.

Payment of Bonus Act, 1965 Section 17

Title: Adjustment of Customary or Interim Bonus Against Bonus Payable Under the Act

Whether in any accounting year (a) an employer has paid any puja bonus or other customary bonus to an employee; or (b) an employer has paid a part of the bonus payable under this Act to an employee before the date on which such bonus becomes payable, then, the employer shall be entitled to deduct the amount of bonus so paid from the amount of bonus payable by him to the employee under this Act in respect of that accounting year and the employee shall be entitled to receive only the balance.

Title: Rights of Individuals to Exact Customary Service from Village Servants Not Affected

Nothing in the last preceding section shall be held to affect any rights of individuals or village communities to exact such service as may be customary from village servants whose watans were originally granted or are now held for the performance of such service, but who have been relieved by 1[the 2[State] Government] of liability to perform such service to the State. ________________ 1 The words "the Provincial Government" were substituted for the word "Government" by the Adaptation of Indian Laws Order in Council. 2 This word was substituted for the word "Provincial" by the Adaptation of Laws Order, 1950.

The Nagaland Jhumland Act, 1970 Complete Act

.....such instruments as the amount to be paid in case of a breach of conditions thereof may, notwithstanding anything in section 74 of the Indian Contract Act. 1872 be recovered from him in case of such branch under the Bengal Demands Recovery Act. 1913 (Bengal Act 3 of 1913) or any other law for the time being in force. 34. Power to remove difficulties (1) If difficulty or doubt arises in giving effect to the provisions of this Act the State Government may by order published in the Gazette, make such provision, not inconsistent with the purpose of this Act as appears to it to be necessary or expedient for the removal if the difficulty or doubt and the Order of the State Government in such cases shall be final. (2) Every order made under his section shall he laid, as soon as may be after it is made, before the Nagaland Legislative Assembly while it is in session for a total period of seven days, which may be comprised in one session or in two successive sessions, and if before the expiry of the session in which it is so laid or the session immediately following the Nagaland Legislative Assembly agree in making any modification in the order or the Nagaland legislative Assembly.....

The Kerala Agrarian Relations Act, 1960 Complete Act

.....granted in respect of any hut not belonging to him and situated. (a) in a plantation; or (b) in any area of land which is appurtenant to a mill, factory or workshop, and in connection with the employment of such person in the plantation, mill, factory or workshop, unless he was, immediately before the commencement of this Act, entitled to the rights of a Kudikidappukaran or the holder of a protected Ulkudi or Kudikidappu under any law. Explanation I.-- For the purpose of this clause "hut" means any dwelling house which has a value not exceeding four hundred rupees or the monthly rent of which does not exceed four rupees. Explanations II.-- Any person who was in occupation of a kudikidappu on the 11th day of April, 1957, and who continued to be in such occupation at the commencement of this Act shll be deemed to be in occupation of such Kudikadappu with permission as required under this clause. Explanation III.-- Where any kudikidappukaran secures any mortgage with possession over the land in which the kudikidappu is situate, his kudikidappu right shall revive on the redemption of the mortgage, provided that he has at the time of the redemption no homestead or land,.....
