ADMINISTRATION OF EVACUEE PROPERTY ACT, 1950 ADMINISTRATION OF EVACUEE PROPERTY ACT, 1950 31 of 1950 An Act to provide for the administration of evacuee property and for certain matters connected therewith. BE it enacted by Parliament as follows:- CHAPTER 01: PRELIMINARY SECTION 01: SHORT TITLE AND EXTENT (1) This Act may be called The Administration of Evacuee Property Act, 1950. (2) It extends to the whole of India except [the territories which immediately before the 1st November 1956, were comprised in the States] of Assam, West Bengal, Tripura, Manipur and Jammu and Kashmir. SECTION 02: DEFINITIONS In this Act, unless the context otherwise requires,- (a) "allotment" means the grant by a person duly authorised in this behalf of a right of use or occupation of any immovable evacuee property to any other person, but does not include a grant by way of lease; (b) "Custodian General" means the Custodian General of Evacuee Property in India appointed by the Central Government under section 5-; (c) "Custodian" means the Custodian for the State, and includes any Additional, Deputy or Assistant Custodian of evacuee property appointed in that State" .....

Title: Special Provisions with Respect to Certain Trust Properties

.....or charitable nature, it shall be lawful for the Central Government, notwithstanding anything contained in the instrument of trust or any law for the time being in force, to appoint by general or special order, new trustees in place of the evacuee trustees and the property shall remain vested in the Custodian only until such time as the new trustees are so appointed; and pending the appointment of such new trustees the trust property and the income thereof shall be applied by the Custodian for fulfilling, as far as possible, the purpose of the trust.] (2) In respect of any Wakf-alal-aulad.-- (a) Where the mutawalli is an evacuee, the property forming the subject-matter of the wakf shall vest in the Custodian subject to the rights of the beneficiaries under the wakf, if any, who are not evacuees; (b) Where not all the beneficiaries are evacuees, the rights and interests of such of the beneficiaries as are evacuees shall alone vest in the Custodian. _____________________________ 1. Title: Power of Private Trustees to Appoint Official Trustee to Be Trustee to Be Trustee of Property

(1) If any property is subject to a trust other than a trust which the Official Trustee is prohibited from accepting under the provisions of this Act, and all the trustees or the surviving or continuing trustee or trustees and all persons beneficially interested in the trust are desirous that the Official Trustee shall be appointed be in the room of such trustee or trustees, it shall be lawful for such of trustee or trustees, by an instrument in writing to appoint the Official Trustee by that name or any other sufficient description with his consent to be the trustee of such property: Provided that the consent of the Official Trustee shall be recited in the said instrument and that such instrument shall be duly executed by him.(2) Upon such appointment such property shall vest in the Official trustee and shall be held by him upon the same trusts as the same was held previously to such appointment, and the previous trustee or trustees shall be exempt from all liability as trustees of such property save in respect of acts done before the date of such appoint
