Title: Prevention and Control of Contagious or Infectious Diseases

Section 9 - Power of State Government to declare infected area (1) On receipt of the report of the Veterinary Officer, under sub-section (3) of section 7 or sub-section (2) of section 8 the prescribed authority shall, after making such further enquiry, as it thinks fit, submit such report with its remarks thereon, if any, to the State Government, which may- (a) confirm any declaration made under sections 7 (1), 7 (3) or 8 (1) either with or without modifications; or (b) cancel any such declaration. (2) ( a ) Where the State Government confirms any such declaration, either with or without modifications, it shall by notification, define the limits of the area to which the declaration with modifications, if any, made therein, shall apply and declare such area to be infected area; (b) the State Government may by notification add, amend, vary or rescind any notification published under clause (a) either on its own motion or on a further report of a Veterinary Officer, submitted through the prescribed authority; (c) on the publication of a notification under clause (a) or (b) any place declared by the Inspector or the Veterinary Officer to be an infected.....

Section 6 - Penalties If any person contravenes any order made under section 3,- (a) he shall be punishable- (i) in the case of an order made with reference to clause (g) or clause (h) of sub-section (2) of that section, with imprisonment for a term which may extend to one year and shall also be liable to fine, and (ii) in the case of any other order, with imprisonment for a term which may extend to three years and shall also be liable to fine: Provided that if the court is of opinion that a sentence of fine only will meet the ends of justice, it may, for reasons to be recorded, refrain from imposing a sentence of imprisonment; and (b) any property in respect of which the order has been contravened or such part thereof as to the court may deem fit shall be forfeited to the Government: Provided that if the court is of opinion that it is not necessary to direct forfeiture in respect of the whole or. as the case may be, any part of the property, it may, for reasons to be recorded, refrain from doing so. Title: Power to Isolate Infective Animals and their Examination and Treatment

.....order cannot be communicated to him without undue delay or the owner or person in charge or having control of the animal fails to comply with the order under sub-section (1) within such time, as in the opinion of the Inspector is reasonable, the Inspector shall seize the animal and remove it to a place of isolation or segregation and may subject it to such treatment as may be necessary. (3) The Inspector shall forthwith report to the Veterinary Officer every order or seizure made under sub-section (1) or sub-section (2). (4) On receipt of a report under sub-section (3), the Veterinary Officer shall as soon as possible, examine the animal and all animals with which it has been in contact or to which it has been in close proximity, and for this purpose may submit any animal to any prescribed test. (5) If, after such examination, the Veterinary Officer,- (a) is of opinion that any animal is not infective, the Inspector shall forthwith return it to the person, who, in his opinion, is entitled to its possession: Provided that where such person cannot, in the opinion of the Inspector, be found, he shall send the animal to the nearest cattlepound or deal with it in such.....
