Title: Punishment for Offences Under This Act and Powers to Compound

.....Zilla Panchayat may authorise in this behalf may accept by way of composition a sum of money not exceeding five hundred rupees from any person, who, in the opinion of the Grama Panchayat, Taluk Panchayat or Zilla Panchayat or the authorised officer, as the case may be, has committed,- (i) any of the aforesaid offences referred to in sub-section (1), or (ii) any other offence under this Act or under any rule, regulation or bye-law made thereunder which may by notification be declared by the Government as compoundable; and on such composition no proceeding shall be taken against such person in respect of such offence. (b) On the composition of any offence under clause (a) if proceedings in any criminal court have been instituted against the person concerned in respect of the offence the composition shall be deemed to amount to an acquittal and no further proceedings shall be taken against such person in respect of such offence.

.....is ordered to be paid as reward by a court whose decision is subject to appeal, the amount ordered to be so paid, shall not be paid until the period prescribed for presentation of the appeal has elapsed, or if an appeal is preferred until after the disposal of the appeal. Section 33 - Composition of offences (1) Any officer authorised by the Authority may accept from any person who has committed or in respect of whom a reasonable belief can be inferred that he has committed an offence punishable under this Act, or the rules made thereunder, a sum of money not exceeding two hundred rupees, by way of composition for such offence. (2) On payment of such sum of money, the said person if in custody, shall be released and no further proceedings shall be taken against him in regard to the offence so compounded.

.....of the water therefrom or uses such water in an unauthorised manner; 1 [(xii) x x x] (xiii) contravenes any provisions of this Act; (xiv) contravenes any rule made under section 71, the contravention whereof is declared in the rules made under that section to be an offence punishable under this section, shall, on conviction, be punished for offences under clauses (vi), (x), (xi) 1 [x x x] with imprisonment for a term which may extend to one year or with fine which may extend to one thousand rupees or with both and for offences under any other clause with imprisonment for a term which may extend to two months, or with fine which may extend to five hundred rupees or with both: Provided that for a second or subsequent offence under clauses (vii) and (viii) such fine shall not be less than fifty rupees and under the other clauses such fine shall not be less than two hundred and fifty rupees: Provided further that in the case of a continuing offence a daily fine not exceeding fifty rupees during the period of the continuance of the offence shall also be imposed. _______________________________ 1. Whoever contravenes any of the provisions of this Act or of any rule shall, if no other penalty is elsewhere provided in his Act or the rules for such contravention, on conviction, be punished with fine which may extend to 1[five thousand] rupees and in the case of a continuing offence to a further fine of 2[fifty] rupees in respect of each day on which the offence continues after such conviction. ____________________ 1. Title: Continuance of Certain Emergency Provisions

(1) Notwithstanding the expiry of the Defence of India Act, 1939, and the Emergency Provisions (Continuance) Ordiance, 1946 (a) the provisions of the Defence of India Rules mentioned in the first column of the Schedule to this Act shall continue in force, and shall have effect subject to the modifications specified in the second column thereof; (b) any order or other instrument made or deemed to be made under or in pursuance of any of the said provisions and in force immediately before the commencement of this Act shall continue in force so far as consistent with the provisions as continued in force by this section and be deemed to be made under or in pursuance of the provisions so continued in force. (2) The references in sub-section (1) to the Defence of India Rules shall be construed as references to those Rules as modified and continued in force by the Emergency Provisions (Continuance) Ordiance, 1946.

.....committed without his knowledge or that he had exercised all due diligence to prevent the commission of such offence. (2) Notwithstanding anything contained in sub-section (1), where any offence under this Act has been committed by a company and it is proved that the offence has been committed with the consent or connivance of, or it attributable to, any neglect on the part of any director, manager, secretary or other officer of the company, such director, manager, secretary or other officer of the company, such director, manager, secretary or other officer shall be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly. Explanation.--For the purposes of this section,-- (a) "company" means any body corporate and includes a firm, society or other association of individuals; and (b) "director",-- (i) in relation to a firm, means a partner in the firm, (ii) in relation to a society or other association of individuals means the person who is entrusted, under the rules of the society or other association, with the management of the affairs of the society or other association, as the case may be.
