Forest Act, 1963 Section 74

Title: Power to Arrest Without Warrant

State: Karnataka

Year: 1963

(1) Any Forest Officer or Police Officer may, without orders from a magistrate and without a warrant, arrest any person reasonably suspected of having been concerned in any forest offence punishable with imprisonment for one month or upwards, if such person refuses to give his name and residence, or gives a name or residence which there is reason to believe to be false, or if there is reason to believe that he will abscond. (2) Any person arrested under this section shall be informed, as soon as may be, of the grounds for such arrest and shall be produced before the nearest magistrate having jurisdiction in the case within a period of twenty-four hours of such arrest excluding the time necessary for the journey from the place of arrest to the court of the magistrate and no such person shall be detained in custody beyond the said period without the authority of a magistrate.

Karnataka Police Act, 1963 Section 141

Title: Police Patel to Arrest Person Whom He Believes to Have Committed a Cognizable Offence, and Forward Him to the Police Station, Etc

(1) It shall be lawful for the Police Patel to arrest any person within the limits of his village, who, he may have reason to believe has committed an offence for which a Police Officer may arrest without warrant and to forward such person within twenty-four hours of such arrest, together with all articles likely to be useful as evidence to the officer in charge of the police station within whose local jurisdiction the village is situated. (2) The Police Patel shall have authority in carrying out any pursuit of alleged criminals to enter and act within the limits of other villages, provided that in such cases immediate information shall be sent to the Police Patel of the village so entered who shall afford all assistance in his power to continue the pursuit.

No cell shall be used for solitary confinement unless it is furnished with the means of enabling the prisoner to communicate at any time with an officer of the Prison and every prisoner so confined in a cell for more than twenty--four hours, whether as a punishment or otherwise, shall be visited at least once a day by the Medical Officer or Medical Subordinate.

Whenever the Superintendent considers it necessary (with reference either to the state of the prison or the character of the prisoners) for the safe custody of any prisoners that they should be confined in irons he may, subject to such regulations and instructions as may be laid down by the Inspector-General with the sanction of the State Government, so confine them.

Title: When Police Officer May Arrest Without Warrant

A Police Officer may arrest without warrant any person committing in his presence in any street or public place any non-cognizable offence punishable under this Act, or under any rule made thereunder and for which no express provision has been made elsewhere, or under any other law for the time being in force, if such person,-- (i) after being warned by a Police Officer persists in committing such offence, or (ii) refuses to accompany the Police Officer to a police station on being required so to do.

Title: Appointment of Places for Confinement of Persons Under Sentence of Imprisonment for Life and Removal Thereto

Section 10 - Appointment of places for confinement of persons under sentence of imprisonment for life and removal thereto (1) The State Government may appoint places within the1[State of Karnataka] to which persons under sentence of imprisonment for life shall be sent; and the State Government or any officer duly authorised in this behalf by the State Government shall give orders for the removal of such person to the place so appointed, except when sentence of imprisonment for life is passed on a person already undergoing imprisonment for life under a sentence previously passed for another offence. (2) In any case in which the State Government is competent under sub--section (1) to appoint places within the State and to order the removal thereto of persons under sentence of imprisonment for life, the State Government may appoint such places in any other State by agreement with the Government of such State and may, by like agreement, give orders or duly authorise any officer to give orders for the removal thereto of such persons. ______________________________________ 1. Title: Power to Arrest for Offence Under Section 42

State: Karnataka

When any person, in the presence of an officer of a prison commits any offence specified in section 42 and refuses on demand of such officer to state his name and residence or gives his name or residence which such officer knows or has reason to believe to be false, such officer may arrest him and shall, without unnecessary delay, make him over to a Police Officer and thereupon such Police Officer shall proceed as if the offence had been committed in his presence.

Karnataka Prisons Act, 1963 Section 61

Title: Confinement in Irons of Prisoners Under Sentence of Imprisonment for Life

State: Karnataka

(1) Prisoners under sentence of imprisonment for life may, subject to such conditions as may be prescribed, be confined, in fetters for the first three months after admission to prison. (2) Should the Superintendent consider it necessary either for the safe custody of the prisoner himself or for any other reason that fetters should be retained on any such prisoner for more than three months, he shall apply to the Inspector-General for sanction to their retention for such period as may be necessary, and the Inspector-General may sanction such retention accordingly.

Section 64 - Rules and notifications to be laid before the State Legislature Every rule made under this Act and every notification issued under section 68, shall be laid as soon as may be after it is made or issued, before each House of the State Legislature while it is in session for a total period of thirty days which may be comprised in one session or in two successive sessions, and if, before the expiry of the session in which it is so laid or the session immediately following, both Houses agree in making any modification in the rule or the notification or both Houses agree that the rule or the notification should not be made or issued, the rule or the notification shall thereafter have effect only in such modified form or be of no effect, as the case may be; so however, that any modification or annulment shall be without prejudice to the validity of anything previously done under that rule or notification.
