THE SIKKIM MUNICIPALITIES ACT, 2007 THE SIKKIM MUNICIPALITIES ACT, 2007 (Act No. 5 of 2007) AN ACT To provide for the municipal governance in the State of Sikkim in conformity with the provisions of the Constitution of India as amended by the Constitution (Seventy-fourth Amendment) Act, 1992, based on the principles of participation in, and decentralization, autonomy, and accountability of, urban self-government at various levels, to improve the quality of life of the urban dwellers of Sikkim, to introduce reforms in financial management and accounting systems, to enhance internal resource generation capacity, to improve the organizational design of Municipalities, to ensure professionalization of the municipal personnel, and to provide for matters connected therewith or incidental thereto. Be it enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows:- PART I PRELIMINARY Chapter I Short title, extend and commencement. 1 (1) This Act may be called the Sikkim Municipalities Act, 2007. THE MIZORAM MUNICIPALITIES ACT, 2007 THE MIZORAM MUNICIPALITIES ACT, 2007 (Act No.6 of 2007) [Received the assent of the Governor of Mizoram on 16th April/2007] An Act to provide for the administration of town areas and to establish municipalities in towns, transitional areas and urban areas in Mizoram. (2) Save as otherwise provided in this Act, sections 2 to 93 shall be deemed to have come into force on the 1st day of April, 2007. CHAPTER 2: RATES OF INCOME-TAX: SECTION 2: Income-tax: (1) Subject to the provisions of sub-sections (2) and (3), for the assessment year commencing on the 1st day of April, 2007, income-tax shall be charged at the rates specified in Part I of the First Schedule and such tax as reduced by the rebate of income-tax calculated under Chapter VIII-A of the Income-tax Act, 1961(43 of 1961) (hereinafter referred to as the Income-tax Act) shall be increased by a surcharge for purposes of the Union calculated in each case in the manner provided therein. THE KERALA DAIRY FARMERS' WELFARE FUND ACT, 2007 ACT 7 OF 2007 THE KERALA DAIRY FARMERS' WELFARE FUND ACT, 2007 AN ACT to provide for the constitution of a Fund to grant relief to, to ensure the welfare of, and to pay pension to the Farmers engaged in cattle rearing in the State of Kerala. Preamble.- WHEREAS, it is expedient to provide for the constitution of a Fund to grant relief to, to ensure the welfare of, and to pay pension to the Farmers engaged in cattle rearing in the State of Kerala and for matters incidental thereto; BE it enacted in the Fifty-eighth Year of the Republic of India as follows:- 1. Short title and commencement.- (1) This Act may be called the Kerala Dairy Farmers' Welfare Fund Act, 2007. (2) It shall be deemed to have come into force on the 24th day of August, 2005. 2. Special Provision for computing deductions in the case of business reorganisation of co-operative banks.-- (1) The deduction under section 32, section 35D, section 35DD or section 35DDA shall, in a case where business reorganisation of a co-operative bank has taken place during the financial year, be allowed in accordance with the provisions of this section. (2) The amount of deduction allowable to the predecessor co-operative bank under section 32, section 35D, section 35DD or section 35DDA shall be determined in accordance with the formula-- A x B C where A = the amount of deduction allowable to the predecessor co- operative bank if the business reorganisation had not taken place; B = the number of days comprised in the period beginning with the 1st day of the financial year and ending on the day immediately preceding the date of business reorganisation; and C = the total number of days in the financial year in which the business reorganisation has taken place. After section 72AA of the Income-tax Act, the following section shall be inserted with effect from the 1st day of April, 2008, namely:-- '72AB. Provisions relating to carry forward and set off of accumulated loss and unabsorbed depreciation allowance in business re-organisation of co-operative banks.-- (1) The assessee, being a successor co-operative bank, shall, in a case where the amalgamation has taken place during the previous year, be allowed to set off the accumulated loss and the unabsorbed depreciation, if any, of the predecessor cooperative bank as if the amalgamation had not taken place, and all the other provisions of this Act relating to set-off and carry forward of loss and allowance for depreciation shall apply accordingly. (2) The provisions of this section shall apply if-- (a) the predecessor co-operative bank-- (i) has been engaged in the business of banking for three or more years; and (ii) has held at least three-fourths of the book value of fixed assets as on the date of the business reorganisation, continuously for two years prior to the date of business reorganisation; (b) the successor co-operative bank-- (i) holds at least three-fourths of.....
