Title: Power to Close Railway Opened for the Public Carriage of Passengers

Where, after the inspection of any railway opened and used for the public carriage of passengers or any rolling stock used thereon, the Commissioner is of the opinion that the use of the railway or of any rolling stock will be attended with danger to the public using it, the Commissioner shall send a report to the Central Government who may thereupon direct that-- (i) the railway be closed for the public carriage of passengers; or (ii) the use of the rolling stock be discontinued; or (iii) the railway or the rolling stock may be used for the public carriage of passengers subject to such conditions as it may consider necessary for the safety of the public.

ASSAM HIGHWAYS ACT, 1989 ASSAM HIGHWAYS ACT, 1989 [ Act No. 18 of 1995] [ 22nd August, 1995] PREAMBLE An Act to provide for the regulation of road development and Road transport in State of Assam Whereas it is expedient to provide generally for the regulation of road development and road transport so as secure for the public such conditions as will ensure the maximum efficiency of all means of road along roads, in the State of Assam. It is hereby enacted in the Fortieth year of the Republic of India as follows, namely : Section 1 - Short title, extent and commencement (1) This Act may be called the Assam Highways Act, 1989. (2) It shall extend to the whole of the State of Assam. (3) It shall come into force on such date as the State Government may, by notification in the official Gazette, appoint. Section 2 - Definitions In this Act, unless there is anything repugnant in the subject or context - (1) "animal" means any elephant, camel, horse, ass, mule, cattle, sheep or goat; (2) "betterment" when applied to land means the increase in the value of any land arising from the execution in its vicinity of a highway development scheme at.....

Section 2 Application of the Act The Industrial Disputes Act, 1947, (hereinafter referred to as the principal Act) shall, in its application to West Bengal, be amended for the purposes and in the manner hereinafter provided. Section 3 Amendment of section 2A of Act 14 of 1947 In section 2A of the principal Act,- (a) after the words "dismisses, retrenches", the words "refuses employment" shall be inserted; (b) after the words "dismissal, retrenchment", the words "refusal of employment" shall be inserted. Section 24 - Temporary suspension of traffic When an accident has occurred on a railway resulting in a temporary suspension of traffic, and either the original lines of rails and works have been restored to their original standard or a temporary diversion has been laid for the purpose of restoring communication, the original lines of rails and works so restored, or the temporary diversion, as the case may be, may, without prior inspection by the Commissioner, be opened for the public carriage of passengers, subject to the following conditions, namely:-- (a) the railway servant incharge of the works undertaken by reason of the accident has certified in writing that the opening of the restored lines of rails and works, or of the temporary diversion will not in his opinion be attended with danger to the public; and (b) a notice of the opening of the lines of rails and works or the diversion shall be sent immediately to the Commissioner. Title: Small Industries Development Assistance Fund

.....Assistance Fund shall be credited. (a) all amounts received for the purpose of that Fund by way of loans, gifts, grants, donations, benefactions or otherwise from Government or any other source; (b) repayments or recoveries in respect of loans, advances or other facilities granted from the Fund. Title: Opening or Breaking a Level Crossing Gate

(1) If any person, other than a railway servant or a person authorised in this behalf, opens any gate or chain or barrier set up on either side of a level crossing which is closed to road traffic, he shall be punishable with imprisonment for a term which may extend to three years. Title: Accounts and Audit of Small Industries Development Assistance Fund

.....Small Industries Development Assistance Fund shall be audited by the auditors, appointed under sub-section (1) of section 30, who shall make a separate report thereon.] (4) The provisions of sub-sections (2), (3) and (4) of section 30 shall, so far as may be, apply in relation to the audit of the Small Industries Development Assistance Fund.
