Deposit Insurance Corporation (Amendment and Miscellaneous Provisions) Act, 1978 Section 7

Title: Power of Central Government to Authorise a Person or Body of Persons to Take over the Management of the Company

.....of the balance in the hands of the person or body of persons authorised under sub-section (1); or (b) the payment of such balance into the general revenue account of the Central Government; and (c) the disposal of the books and papers of the Company. (7) A copy of the order' made by the Central Government for the dissolution of the Company shall be filed by the re-named Corporation with the Registrar of Companies within thirty days from the date of such order and the Registrar of Companies shall give effect to the said order as if it were an order made by the court for the dissolution of the Company. (8) The provisions of this section shall have effect notwithstanding anything to the contrary contained in the Companies Act, 1956 1 of 1956, or in any other law for the time being in force.

Section 10 Breaches of official duty in connection with election (1) If any person to whom this section applies is without reasonable cause guilty of any act or omission in breach of his official duty, he shall be punishable with fine which may extend to five hundred rupees. (2) No suit or other legal proceedings shall lie against any such person for damages in respect of any such act or omission as aforesaid. (3) The persons to whom this section applies are the Registering Authorities for preparation or revision of electoral rolls, returning officers (which expression shall mean the Chairman of the Commissioners of municipalities in reference to elections under the Bengal Municipal Act, 1932), presiding officers, polling officers and any other person appointed to perform.....

Title: Procedure for Closing Down an Undertaking

.....of the workmen by registered post with acknowledgement due. (2) Where a notice has been served on the State Government by an employer under sub-section (1) of section 25FFA and the period of notice had not expired on the 5th August, 1983, such employer shall not close down the undertaking but shall, within a period of fifteen days from the said date, apply to the State Government for permission to close down the undertaking. (3) Where an application for permission has been made under sub-section (1) or sub-section (2) the State Government after making such enquiry as it thinks fit and after giving a reasonable opportunity of being heard to the employer, the workmen and the persons interested in such closure may, having regard to the genuineness and adequacy or the reasons stated by employer, the interests of the general public and all other relevant factors, by order and for reasons to be recorded in writing, grant or refuse to grant such permission and copy of such order shall be communicated to the employer and the workmen. (4) Where an application has been made under sub-section (1) or sub-section (2) as the case may be, and the State Government does not communicate.....

.....(1), any canal or part thereof is closed and filled up or any canal side road is closed to traffic, the State Government may deal with the space covered by such filled up canal or part thereof or by such road, in such manner as it may consider fit. Section 4 No compensation for damage No suit or other legal proceeding shall lie against the State Government in respect of any injury or damage caused by, or resulting from stoppage of navigation in the canals or of use of the canal side roads, or any act done under this Act. Section 5 Indemnity No suit, prosecution or other legal proceeding shall lie against the State Government or any officer of the State Government or other person in respect of any act which is in good faith done or intended to be done under this Act. Title: Special Provision as to Restarting Undertakings Closed Down Before Commencement of the Industrial Disputes (Amendment) Act, 1976

Title: Revival of Levy of Wealth-tax in the Case of Closely-held Companies

(v) land other than agricultural land; (vi) building or land appurtenant thereto, other than building or part thereof used by the assessee as factory, godown, warehouse, hotel or office for the purposes of its business or as residential accommodation for its employees or as a hospital, enter, school, canteen, library, recreation enter, shelter, rest-room or lunch room mainly for the welfare of its employees and the land appurtenant to such building or part : Provided that each such employee is an employee whose income (exclusive of the value of all benefits or amenities not provided for by way of monetary payment) chargeable under the head "Salaries" under the Income-tax Act does not exceed eighteen thousand rupees; (vii) motor-cars; and (viii) any other asset which is acquired or represented by a debt secured on any one or more of the assets referred to in clause (i) to clause (vii). (4) The value of any asset specified in sub-section (3) shall, subject to the provisions of sub-section (3) of section 7 of the Wealth-tax Act, be estimated to be the price which, in the opinion of the Wealth-tax Officer, it would fetch if sold in the open market on the valuation.....

Title: Power of Collector to Close Places Where Intoxicant or Hemp is Sold in Certain Cases

Power of Collector to close places where intoxicant or hemp is sold in certain cases (1) If the Collector is of opinion that it is in the interest of public peace to close any place in which any intoxicant or hemp is sold, it shall be lawful for the Collector by an order in writing to the persons holding a licence for the sale of such intoxicant or hemp to require him to close such place at such time or for such period as may be specified in the order. (2) If a not or unlawful assembly is imminent, or takes place; it shall be lawful for any Executive Magistrate or Police Officer who is present to direct that such place shall be closed and kept closed for such period as he thinks fit, and in the absence of any Executive Magistrate or Police Officer the person referred to in Sub-section (1) shall himself close such place. Wild Birds and Animals Protection Act, 1912 Section 3

The State Government may, by notification in the Official Gazette, declare the whole year or any part thereof to be a close time throughout the whole or any part of its territories for any kind of wild bird or animal to which this Act applies, or for female or immature wild birds or animals of such kind; and, subject to the provisions hereinafter contained, during such close time, and within the areas specified in such notification, it shall be unlawful-- (a) to capture any such bird or animal, or to kill any such bird or animal which has not been captured before the commencement of such close time; (b) to sell or buy, or offer to sell or buy, or to possess, any such bird or animal which has not been captured or killed before the commencement of such close time, or the flesh thereof; (c) if any plumage has been taken from any such bird captured or killed during such close time, to sell of buy, or to offer to sell or buy, or to possess, such plumage.

Title: Power to Close Roads and Open Spaces

.....of access, or (b) whose immovable property was receiving air and light on account of such open space or part, and who has suffered damage-- (i) in any case falling under clause (a) from such discontinuance or closure and (ii) in any case falling under clause (b) from the use to which the Corporation has put such open space or part. (3) In determining the compensation payable to any person under sub-section (2), the Corporation may take into consideration any benefit accruing to such person from the construction, provision or improvement of any other road, or open space at or about the same time that the road or open space or part thereof, on account of which the compensation is to be paid, is discontinued or closed. (4) When any road or open space or any part thereof is permanently closed under sub-section (1), the Corporation may sell or leave such part of it as is not required for its purposes.
