THE CHURCH OF SCOTLAND KIRK SESSIONS Act, 1899 [Act, No.23 of 1899] [27th September, 1899.] PREAMBLE An Act to provide for the Incorporation of Kirk Sessions of the Church of Scotland in { Substituted by the A, O, 1950 for "the Provinces"} [India]. WHEREAS there are in{ Subs. by the A, O, 1950 for "the Provinces".} [India] Kirk Sessions of the Church of Scotland which have been duly constituted to be Church Courts for ecclesiastical purposes in pursuance of Acts of the General Assembly of the Church of Scotland; And whereas it is expedient that such Kirk Sessions and any others which may hereafter be so constituted, should be incorporated with the powers hereinafter provided; It is hereby enacted as follows:--

.....such Kirk Sessions and any others which may hereafter be so constituted, should bt incorporated with the powers hereinafter provided; It is hereby enacted as follows:- SECTION 01: SHORT TITLE AND EXTENT (1) This Act may be called The Church of Scotland Kirk Sessions Act 1899-, (2) It extends to the whole of India except 3[the territories which, immediately before the 1st November, 1936, were comprised in Part B States]4[* *]. 4[(3)* * * *] SECTION 02: SCOTCH KIRK SESSIONS TO BE BODIES CORPORATE (1) Every Kirk Sessions which has been. or may hereafter be, duly constituted to be a Church Court for ecclesiastical purposes in pursuance of an Act of the General Assembly of the Church of Scotland, is hereby declared to be, and the same shall be, a body corporate having perpetual succession and a common seal. (2) A notification by the Central Government in the Official Gazette that a Kirk Session has been duly constituted5in pursuance of an Act of the General Assembly of the Church of Scotland shall be conclusive proof that it has been so constituted. SECTION 03: POWER TO HOLD AND DISPOSE OF PROPERTY (1) Every Kirk Session constituted as aforesaid shall, as a body.....

Title: English Minister Refusing to Perform Ceremony to Permit Use of His Church

When any Minister of any Church or Chapel of the said1[***] Church refuses to perform such marriage-service between any persons who but for such refusal would be enlitled to have the same service performed in such Church or Chapel, such Minister shall permit any other Minister in Holy Orders of the said Church, entitled to officiate within the diocese in which such Church or Chapel is situate, to perform such marriage-service in such Church or Chapel. ______________________ 1. Title: Persons Authorized to Solemnize Marriage (Other Than Clergy of Churches of England, Scotland or Rome)

.....rules, rites, ceremonies and customs of that church, or, not being a Clergyman of the Church of Rome, solemnizing a marriage according to the rites, rules, ceremonies and customs of that church, knowingly and wilfully issues any certificate for marriage under this Act, or solemnizes any marriage between such persons as aforesaid, without publishing, or causing to be affixed, the notice of such marriage as directed in Part III of this Act, or after the expiration of two months after the certificate has been issued by him; issuing certificate for, or solemnizing, marriage with minor, within fourteen days after notice ;.- or knowingly and wilfully issues any certificate for marriage, or solemnizes a marriage between such persons when one of the persons intending marriage is a minor, before the expiration of fourteen days so after the receipt of notice of such marriage, or without sending, by mat the post or otherwise, a copy of such notice to the Marriage Registrar, or, if there be more Marriage Registrars than one, to the Senior Marriage Registrar of the district ; issuing certificate authorizedly forbidden ;.- or knowingly and wilfully issues any certificate the issue of which.....

.....{For notification declaring the Kirk Sessions at Calcutta Madras, Bombay and Allahabad to be duly constituted, see Gazette of Indian 1900 , Pt.I, p.706 respect of the Kirk Session Simla and the Kirk Session at Simla and the Kirk Session at Poona, see ibid 1905, Pt, I p, 706 respectively.} in pursuance of an Act of the General Assembly of the Church of Scotland, is hereby declared to be and the same shall be a body corporate having perpetual succession and a common seal. Government of India Act, 1915-19 [Repealed] Section 122

Title: Establishment of Chaplains of Church of Scotland

(1) Two members of the establishment of Chaplains maintained in each of the presidencies of Bengal, Madras and Bombay must always be ministers of the Church of Scotland, and shall be entitled to have, out of the revenues of India, such salary as is from time to time allotted to the military chaplains in the several presidencies. (2) The ministers so appointed chaplains must be ordained and inducted by the presbytery of Edinburgh according to the forms and solemnities used in the Church of Scotland and shall be subject to the spiritual and ecclesiastical jurisdiction in all things of the presbytery of Edinburgh, whose judgments shall be subject to dissent, protest and appeal to the Provincial Synod of Lothian and Tweed dale and to the General Assembly of the Church of Scotland.

Christian Marriage Act1872 Section 31

Title: Registration and Returns of Marriages Solemnized by Clergymen of Church of Scotland

Year: 1872

Every Clergyman of the Church of Scotland shall keep a register of marriages, and shall register therein, according to the tabular form set forth in the Third Schedule hereto annexed, every marriage which he solemnizes under this Act, and shall forward quarterly to the {Subs by Act of 1886, section.30 (b), for " Secretary to the L. G ".} [Registrar General of Births, Deaths and Marriages], through the Senior Chaplain of the Church of Scotland, returns, similar to those prescribed in section 29, of all such marriages.
