The person who immediately before the appointed day is the Chairman or Deputy Chairman of the Legislative Council of the existing State of Bihar shall continue to be the Chairman or Deputy Chairman, as the case may be, on and from that day of that Council.

.....if he- a. is found, in performance of his functions under this Act, to have exceeded or abused his powers; or b. refuses to act or is incapable of acting or acts in a manner which the Government consider to be prejudicial to the interests and objects of the Council: Provided that no action shall be taken under this sub-section without giving the person concerned an opportunity to show cause against the proposed action; and (3-a) The Government may at any time, by an order published in the Gazette, withdraw the nomination of a member nominated on the Council and, upon such nomination being withdrawn, he shall Cease to be a member of the Council from the date of publication of the order. 4. When the office of a member including the Chairman becomes vacant by his resignation, removal death or otherwise, the vacancy shall be filled up in the same manner in which he was taken. 5. The Chairman of Council shall enjoy the status of a Minister of State of Orissa and shall be entitled to such remuneration and allowances as may be prescribed. 6. (4) Where any body corporate constituted under a Central Act, State Act or Provincial Act for the existing State of Bihar or any pan thereof has, by virtue of the provisions of Part II, becomes an inter-State body corporate, the investments in, or loans or advances to, any such body corporate by the existing State of Bihar made before the appointed day shall, save as otherwise expressly provided by or under this Act, be divided between the States of Bihar and Jharkhand in the same proportion in which the assets of the body corporate are divided under the provisions of this part. Title: Appointment of Teachers and Other Employees of the University

.....to the direct recruitment vacancies arranging the names in the order of merit being determined on the basis of the percentage of marks obtained by them in the qualifying examinations and the marks awarded in the interview. (4) While preparing the select list under sub-section (3), the Board shall follow the rules or orders issued by the State Government from time to time in the matter of reservation of appointments or posts for persons belonging to Scheduled Castes and Scheduled Tribes and Other Backward Classes, under Article 16(4) of the Constitution. (5) All appointments shall be made by the Syndicate by operating the select list prepared by the Board in the order of merit in which the names have been arranged. If any difference arises between the Board and the Syndicate, the matter shall be referred to the Chancellor, through the State Government in the Department of Education. The decision of the Chancellor upon such reference shall be final. (6) The quorum for the meeting shall be four.

.....day, the Delimitation of Parliamentary and Assembly Constituencies Order, 1976, shall stand amended as directed in the Second Schedule to this Act Section 11 - Provision as to sitting members (1) Every sitting member of the House of the People representing a constituency which, on the appointed day by virtue of the provisions of section 10, stands allotted, with or without alteration of boundaries, to the successor State of Bihar or Jharkhand, shall be deemed to have been elected to the House of the People by that constituency as so allotted.
