.....means the Chairman of the Board appointed under section 4-of the Act; (d) "Member" means a Member of the Board appointed under section 4-of the Act. RULE 03: Pay (1) The Chairman shall receive pay as admissible to a Judge of a High Court. (2) A Member shall receive pay as admissible to the Secretary to the Government of India: Provided that in the case of an appointment of a person as a Chairman, or as a Member, who has retired as a Judge of a High Court or who has retired from service under the Central Government or a State Government and who is in receipt of or has received or has become entitled to receive any retirement benefits by way of pension, gratuity, employer's contribution to the Contributory Provident Fund or other forms of retirement benefits, the pay of such Chairman or Member shall be reduced by the gross amount of pension and pension equivalent of gratuity or employer's contribution to the Contributory Provident Fund or any other form of retirement benefit, if any, drawn or to be drawn by him. RULE 04: DEARNESS ALLOWANCE AND CITY COMPENSATORY ALLOWANCE (1) The Chairman shall receive dearness allowance and city compensatory allow- ance at the rate.....

Title: Provision as to the Holding of Offices by Chairman, Vice-chairman Etc., on Ceasing to Be Such Chairman or Vice-chairman, Etc.

.....of a State; (c) a Member (other than the Chairman or Vice-Chairman) shall, subject to the other provisions of this Act, be eligible for appointment as the Chairman or Vice-Chairman or as the Chairman, Vice-Chairman or member of any other Tribunal established under any law for the time being in force, but not for any other employment either under the Government of India or under the Government of a State; (d) the Chairman, Vice-Chairman or other Member shall not appear, act or plead before the Claims Tribunal. Explanation.--For the purposes of this section, employment under the Government of India or under the Government of a State includes employment under any local or other authority within the territory of India or under the control of the Government of India or under any corporation or society owned or controlled by the Government.

Title: Refusal to Hand over Charge to New Chairman or Vice-chairman

.....Market Committee is functioning for seizing and taking possession of the records, funds and property of the Market Committee in the possession of such Chairman or Vice-Chairman and handing over possession thereof to the successor-in-office. (4) On receipt of an application under sub-section (3), the Executive Magistrate may authorise any police officer, not below the rank of a sub-inspector, to enter and search any place where the records, funds and property are kept or are likely to be kept and to seize them and hand over possession thereof to the person specified in such application. (5) The provisions of the Code of Criminal Procedure, 1973, shall apply to every search and seizure made under this Act.

Manipur (Hill Areas) District Councils Act, 1971 Section 23

.....if such resolution is passed by less than two-thirds but not less than one-half of the total membership of the Council, the Administrator may, by order in writing remove, for reasons to be recorded, the Chairman from his office as from such date as may be specified in the order: Provided that no such resolution shall be brought within one year from the date of election of the Chairman : Provided further that if the resolution is not passed by not less than two-thirds of the total membership of the Council, no other resolution for the removal of the Chairman shall be allowed to be considered within one year from the date on which such resolution was considered. (3) A notice in writing of the intention to move a resolution referred to in sub-section (2) signed by not less than one-third of the total membership of the Council together with a copy of the proposed resolution shall be delivered to the Deputy Commissioner in accordance with the rules made by the Deputy Commissioner in this behalf and the Deputy Commissioner shall after giving not less than fifteen days notice thereon convene for consideration of the resolution a meeting of the Council to be held in the office.....

Title: Vice-chairman or Senior-most Member to Act as Chairman or Discharge His Functions in Certain Circumstances

(1) In the event of or any vacancy in the office of the Chairman by reasons of his death, resignation or otherwise, the Vice-Chairman and in his absence the senior-most Member shall act as Chairman until the date on which a new Chairman, appointed in accordance with the provisions of this Act to fill such vacancy, enters upon his office. (2) When the Chairman is unable to discharge his functions owing to his absence, illness or any other cause, the Vice-Chairman and in his absence the senior-most Member shall discharge the functions of the Chairman until the date on which the Chairman resumes his duty.

Title: Powers and Functions of the Chairman and Vice-chairman

.....The powers and functions of the Vice-Chairman shall be,-- (a) to exercise the powers and perform the functions conferred on the Chairman under sub-section (1) or delegated to him under sub-section (3), in the absence of the Chairman on leave or on tour abroad or for any other similar reasons; (b) to act as ex-officio member in all the Committees or Sub-Committees appointed by the Managing Body. (3) The Chairman and the Vice-Chairman shall, in addition to the powers exercisable by them under sub-sections (1) and (2), exercise such other financial and administrative powers as may be delegated to them by the Managing Body in accordance with rules made by it under section 5.

Title: The Chairman or the Deputy Chairman Not to Preside While Aresolution for His Removal from Office is Under Consideration

(1) At any sitting of the Legislative Council, while any resolution for the removal of the Chairman from his office is under consideration, the Chairman, or while any resolution for the removal of the Deputy Chairman from his office is under consideration, the Deputy Chairman, shall not, though he is present, preside, and the provisions of clause (2) of article 184 shall apply in relationto every such sitting as they apply in relation to a sitting from which the Chairman or, as the case may be, the Deputy Chairman is absent. (2) The Chairman shall have the right to speak in, and otherwise to take part in the proceedings of, the Legislative Council while any resolution for his removal from office is under consideration in the Council and shall, notwithstanding anything in article 189, be entitled to vote only in the first instance on such resolution or on any other matter during such proceedings but not in the case of an equality of votes.

Title: Vacancies in Office of Chairman and Vice-chairman

(1) In the event of a vacancy in the office of the Chairman or the Vice-Chairman by reason of death, resignation, or otherwise, the vacancy shall be filled as soon as possible,-- (a) by nomination, in the case of a Market Committee constituted for the first time; and (b) in any other case, in the manner provided in sub-section (3) or, as the case may be, sub-section (4) of section 9. (2) Every Chairman or Vice-Chairman nominated or elected, as the case may be, under this section, to fill a casual vacancy shall hold office for such period as the Chairman or the Vice-Chairman in whose place he is nominated, or as the case may be, elected, would have held such office if the vacancy had not occurred.
