Title: Part Vi Not to Apply to Roman Catholics. Saving of Certain Marriages

This Part of this Act, except so much of sections 62 and 63 as are referred to in section 64, shall not apply to marriages between Roman Catholics. But nothing herein contained shall invalidate any marriage celebrated between Roman Catholics under the provisions of Part V of Act No.25 of 1864 {Act 25 of 1864 had been rep. by Act 5 of 1865, which was rep. by this Act.}, previous to the twenty-third day of February, 1865.

.....until the expiration of four days after the date of the receipt of the notice by such Minister; (2) that no lawful impediment be shown to his satisfaction why such certificate should not issue; and (3) that the issue of such certificate has not been forbidden, in manner hereinafter mentioned, by any person authorized in that behalf. SECTION 18: Declaration before issue of certificate: The certificate mentioned in (section 17) shall not be issued and until one of the persons intending marriage has appeared personally before the Minister and made a solemn declaration- (a) that he or she believes that there is not any impediment of kindred or affinity or other lawful hindrance, to the said marriage. (b) that the consent or consents required by law has or have been obtained thereto, or that there is no person resident in India having authority to give such consent, as the case may be. .....Commission of Inquiry known as the Bank Award Commission, consisting of a. Judge of the Bombay High Court. The Commission was requested to conduct a fact-finding enquiry and make recommendations as regards the further modifications, if any necessary in the decision of the Labour Appellate Tribunal as adapted by the Government's Modification Order. The Commission submitted its recommendations towards the end of July 1955. Government have accepted in full the recommendations of the Commission on the substantive terms of the award. This Bill is designed to give effect to the recommendations of the Commission. Considering that the dispute has been pending since 1949 and that it has taken so long to finalise the terms and conditions of service of the employees in question, it is considered desirable that those terms and conditions should remain in operation for at least five years instead of the normal period of one year provided for in the Industrial Disputes Act, 1947. The Bill accordingly makes the necessary provision in this regard. 2. SECTION 13: FIRST INTERROGATION OF RESPONDENT The respondent, if such points be proved to the satisfaction of the Judge, shall thereupon be asked whether she or he refuses to cohabit with the petitioner, and, if so, what is the ground of such refusal. In ordinary cases such interrogation and every other interrogation prescribed by this Act shall be made by the Judge, but when the respondent is exempt by law from personal appearance in Court, or when the Judge shall, in his discretion, excuse the respondent from such appearance, the interrogations shall be made by Commissioners acting under such commission as hereinafter mentioned. SECTION 14: INTERROGATIONS BY JUDGE MAY BE PUBLIC OR PRIVATE Every interrogation mentioned in this Act and made by the Judge may, at the discretion of the Judge, take place in open court or in his private room. Title: Time and Palace at Which Marriages May Be Solemnized

.....or special license in that behalf from the Roman Catholic Bishop of the Diocese or Vicariate in which such marriage is so solemnized, or from such person as the same Bishop has authorized to grant such license, license, {Ins. by Act 2 of 1891, section.2} [or (3) a Clergyman of the Church of Scotland solemnizing a marriage according to the rules, rites, ceremonies and customs of the Church of Scotland]. Section 11 - Place for solemnizing marriage No Clergyman of the Church of England shall solemnize a marriage in any place other than a church {Ins. by section.3, ibid.} [where worship is generally held according to the forms of the Church of England], unless there is no {Ins. by section.3, ibid.} [such] church within five miles distance by the shortest road from such place, or unless he has received a special license authorizing him to do so under the hand and seal of the Anglican Bishop of the Diocese or his Commissary. Fee for special license.- For such special license, the Registrar of the Diocese may charge such additional fee as the said Bishop from time to time authorizes.

Title: Time for Solemnizing Marriage

Every marriage under this Act shall be solemnized between the hours of six in the morning and seven in the evening : Exceptions.- Provided that nothing in this section shall apply to (1) a Clergyman of the Church of England solemnizing a marriage under a special license permitting him to do so at any hour other than between six in the morning and seven in the evening, under the hand and seal of the Anglican Bishop of the Diocese or his Commissary, or (2) a Clergyman of the Church of Rome solemnizing a marriage between the hours of seven in the evening and six in the morning, when he has received a general or special license in that behalf from the Roman Catholic Bishop of the Diocese or Vicariate in which such marriage is so solemnized, or from such person as the same Bishop has authorized to grant such license, license, {Ins. by Act 2 of 1891, section.2} [or (3) a Clergyman of the Church of Scotland solemnizing a marriage according to the rules, rites, ceremonies and customs of the Church of Scotland].
