THE CARDAMOM (AMENDMENT) ACT, 1977 [No. 26 of 1977] [2nd August, 1977] An Act to amend the Cardamom Act, 1977. BE it enacted by Parliament in the Twenty-eighth Year of the Republic of India as follows :-- 1. Short title. This Act may be called the Cardamom (Amendment) Act, 1977. 2 . Amendment of section 14. In section 14 of the Cardamom Act, 1965 (42 of 1965.) (hereinafter referred to as the principal Act), in sub-section (1), for the words "not exceeding two per cent.ad valorem", the words "not exceeding five per cent ad valorem" shall be substituted. 3 . Amendment of section 33. In section 33 of the principal Act, in sub-section (3), for the words "in two successive sessions, and if, before the expiry of the session in which it is so laid or the session immediately following", the words "in two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid" shall be substituted.

.....fees levied and collected in respect of licences issued under this Act; (c) any other fee that may be levied and collected by the Board under this Act or the rules made thereunder; (d) any grants or loans that may be made by the Central Government for the purposes of the Fund; (e) any grants or loans that may be made by any institution for the purposes of this Act; (f) all sums realised by the Board in carrying out the measures referred to in section 9. (2) The Fund shall be applied- (a) for meeting the salaries, allowances and other remuneration of the officers and other employees of the Board; (b) for meeting the other administrative expenses of the Board; (c) for meeting the cost of the measures referred to in section 9; (d) for repayment of any loans from the Central Government or from any institution. 18. .....on the security of the Cardamom Fund or any of its other assets, for meeting its expenses or for any other purposes referred to in Sec. 9-of the Act RULE 38: POWERS AND DUTIES OF CHAIRMAN -(1) The Chairman shall be responsible for the proper functioning of the Board and the discharge of its duties under the Act and these rules. (2) Subject to the provisions of these rules, the Chairman may delegate his power under this rule to any other officer of the Board. Title: Transfer of Assets and Liabilities of the Cardamom Board and the Spices Export Promotion Council to the Board

.....hold his office or service under the Board with the same rights and privileges as to pension, gratuity and other matters as would have been admissible to him if there had been no such vesting; and shall continue to do unless and until his employment under the Board is duly terminated or until his remuneration and other conditions of service are duly altered by the Board. (2) Notwithstanding anything contained in the Industrial Disputes Act, 1947 or in any other law for the time being in force, the absorption of any employee by the Board in its regular service under this section shall not entitle such employee to any compensation under that Act or other law and no such claim shall be entertained by any Court, tribunal or other authority.

Title: Power to Control Price and Distribution of Cardamom

.....or the maximum and minimum prices, which may be charged by a grower of cardamom or cardamom dealer, wholesaler or retail, whether for the Indian market or for export; and (b) the maximum quantity which may in one transaction be sold to any person. (2) Without prejudice to the generality of the powers conferred by sub-section (1), any order made thereunder may provide-- (a) for requiring persons engaged in the production, supply or distribution of, or trade and commerce in, cardamom to maintain and produce for inspection such books, accounts and records relating to their business and to furnish such information relating thereto as may be specified in the order; and (b) for such other matters, including in particular the entering and search of premises, vehicles, vessels and aircraft, and the seizure by a person authorised to make such search,of cardamom in respect of which such person has reason to believe that a contravention of the order has been, is being or is about to be, committed.

Title: Short Title, Extent and Commencement

(1) This Act may be called the Cardamom Act, 1965. (2) It extends to the whole of India: Provided that it shall not apply to the State of Jammu and Kashmir except to the extent to which the provisions of this Act relate to the control of export of cardamom from India and import thereof into India. (3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint: Provided that different dates may be appointed for different provisions of this Act.
