Cantonments Act, 2006 Chapter II

Title: Definition and Delimitation of Cantonment

.....by general or special order, direct. Section 8 - Application of funds and property transferred under sections 6 and 7 Any cantonment fund or a cantonment development fund or a portion thereof or other property of a Board vesting in the Central Government under *he provisions of section 6 or section 7 shall be applied in the first place to satisfy any liabilities of the Board transferred under such provisions to that Government, and in the second place for the benefit of the inhabitants of the local area which has ceased to be a cantonment or, as the case may be, part of a cantonment. Section 9 - Limitation of operation of Act The Central Government may, by notification in the Official Gazette, exclude from the operation of any part of this Act the whole or any part of a cantonment, or direct that any provision of this Act shall, in the case of any cantonment -- (a) situated with the limits of a metropolitan area; or (b) in which the Board is superseded under section 60, apply with such modification as may be so specified.

.....borrow money from another Board, on mutually agreeable terms any sum of money which may be required for the schemes or projects covered under this Act. Amendment of section 1 In the Cantonments (Extension of Rent Control Laws) Act, 1957 (46 of 1957) (hereinafter referred to as the principal Act), section 1 shall be renumbered as sub-section (1) thereof, and after sub-section (1), as so re-numbered, the following sub-section shall be inserted, namely:-- "(2) It shall be deemed to have come into force on the 26th day of January, 1950.". 3. Amendment of section 3 Section 3 of the principal Act shall be re-numbered as sub-section (1) thereof, and-- (i) in sub-section (1) as so renumbered, the words "on the date of the notification" shall be, and shall be deemed always to have been, omitted; (ii) after sub-section (1) , as so re-numbered, the following sub-section shall be, and shall be deemed always to have been, inserted, namely:- '(2) The extension of any enactment under sub-section (1) may be made from such earlier or future date as the Central Government may think fit: Provided that no such extension shall be made form a date earlier than-- (a) the commencement of such enactment, or (b) the establishment of the cantonment, or (c) the commencement of this Act, whichever is later. Title: Removal and Exclusion from Cantonments and Suppression of Sexual Immorality

.....the owner, lessee, tenant or occupier, as the case may be, to discontinue such use of the building within such period as may be specified in the order. Section 300 - Penalty for loitering and importuning for purposes of prostitutionn (1) Whoever in a cantonment loiters for the purpose of prostitution or importunes any person to the commission of sexual immorality, shall be punishable with imprisonment which may extend to three months, or with fine which may extend to five thousand rupees and in case of subsequent offence shall be punishable with imprisonment which may extend to one year. (2) No prosecution for an offence under this section shall be instituted except on the complaint of the person importuned, or of a military officer in whose presence the offence was committed, or of a member of the Military, Naval or Air Force Police, being employed in the cantonment and authorised in this behalf by the Officer Commanding the Station, in whose presence the offence was committed, or of a police officer not below the rank of Assistant Sub-Inspector, who is deployed in the cantonment and authorised in this behalf by the Officer Commanding the Station with the concurrence.....
