.....2015 THE ARBITRATION AND CONCILIATION (AMENDMENT) ACT, 2015 NO. 3 OF 2016 [31st December, 2015.] An Act to amend the Arbitration and Conciliation Act, 1996. BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows: Short title and commencement. 1. (1) This Act may be called the Arbitration and Conciliation (Amendment) Act, 2015. (2) It shall be deemed to have come into force on the 23rd October, 2015. Amendment of section 2. 2. In the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the principal Act), in section 2, (I) in sub-section (1), (A) for clause (e), the following clause shall be substituted, namely: (e) Court means (i) in the case of an arbitration other than international commercial arbitration, the principal Civil Court of original jurisdiction in a district, and includes the High Court in exercise of its ordinary original civil jurisdiction, having jurisdiction to decide the questions forming the subject-matter of the arbitration if the same had been the subject-matter of a suit, but does not include any Civil Court of a grade inferior to such principal Civil Court, or any Court of Small Causes; (ii) in the.....

Title: Punishment for Wrongful Withholding of Property

(1) If any officer or employee of a company-- (a) wrongfully obtains possession of any property, including cash of the company; or (b) having any such property including cash in his possession, wrongfully withholds it or knowingly applies it for the purposes other than those expressed or directed in the articles and authorised by this Act, he shall, on the complaint of the company or of any member or creditor or contributory thereof, be punishable with fine which shall not be less than one lakh rupees but which may extend to five lakh rupees. (2) The Court trying an offence under sub-section (1) may also order such officer or employee to deliver up or refund, within a time to be fixed by it, any such property or cash wrongfully obtained or wrongfully withheld or knowingly misapplied, the benefits that have been derived from such property or cash or in default, to undergo imprisonment for a term which may extend to two years.

Title: Repeal of Certain Enactments and Savings

Title: Admissibility of Certain Documents as Evidence

Notwithstanding anything contained in any other law for the time being in force, any document reproducing or derived from returns and documents filed by a company with the Registrar on paper or in electronic form or stored on any electronic data storage device or computer readable media by the Registrar, and authenticated by the Registrar or any other officer empowered by the Central Government in such manner as may be prescribed, shall be deemed to be a document for the purposes of this Act and the rules made thereunder and shall be admissible in any proceedings thereunder without further proof or production of the original as evidence of any contents of the original or of any fact stated therein of which direct evidence is admissible.

Title: Intimation to Company Liquidator, Provisional Liquidator and Registrar
