THE SUGAR-CANE ACT, 1934 [Act, No. 15 of 1934] [1st May, 1934] PREAMBLE An Act to regulate the price of sugar-cane intended for use in sugar factories. WHEREAS it is expedient, for the purpose of assuring to sugarcane growers a fair price for their produce, to regulate the price at which sugar-cane intended to be used in the manufacture of sugar may be purchased by or for factories; It is hereby enacted as follows:

Title: Penalty for Purchase of Sugar-cane in Contravention of Notification Under Section 3

Whoever in any controlled area purchases any sugar-cane intended for use in a factory at a price less than the minimum price fixed therefor by notification under sub-section (2) of section 3 or in contravention of any prohibition made under sub-section (3) of section 3 shall be punishable with fine which may extend to two thousand rupees.

.....of licences to purchasing agents, the fees for such licences, and the regulation of the purchase and sale of sugar-cane by and to such agents; (d) the organisation of growers of sugar-cane into societies for the sale of sugar cane to factories; (e) the authorities by which any functions under this Act or the rules made there under are to be performed; and (f) the records registers and accounts to be maintained for ensuring compliance with the provisions of this Act. (3) In making any rule under sub-section (1) or under clause (c) or Cl. (f) of sub-section (2), the11 [State Government] may provide that a breach of the rule shall, where no other penalty is provided by this Act, be punishable with fine not exceeding two thousand rupees. SECTION 08: POWER OF STATE GOVERNMENT TO MAKE RULES The13[State Government] after previous publication may, by notification in the14[Official Gazette], make rules providing for the exemption of factories or any class of factories from the provisions of this Act. Sugar Undertakings (Taking over of Management) Act, 1978 Chapter III

Title: Relief to Sugar Undertakings and Cane Producing Farmers

.....fit to the Custodian-General and the Custodians to facilitate the speedy clearance of arrears of cane dues so as to avoid undue hardship to cane producing farmers. (2) Without prejudice to the provisions of sub-section (1), the Central Government may render such assistance in such manner as it may deem fit to any notified sugar undertaking to enable the undertaking to clear the whole or any part of its arrears of cane dues so as to avoid undue hardship to cane producing farmers. Explanation. For the purposes of this section, the expression "arrears of cane dues" shall he construed in accordance with the provisions of Cls. (a) and (b) of sub-section (6) of section 3.

(1) The Central Government may issue such directions as it deems fit to the Custodian-General and the Custodians to facilitate the speedy clearance of arrears of cane dues so as to avoid undue hardship to cane producing farmers. .....decree or order directing the refund of any cess paid under any State Act; and (c) any cess imposed or assessed under any State Act before the commencement of this Act but not collected before such commencement may be recovered (after assessment of the cess, where necessary) in the manner provided under that Act. .....Section 1 - Short title and commencement (1) This Act may be called the Uttarakhand [the Uttar Pradesh Cane (Regulation of Supply and Purchase) Act, 1953] (Amendment) Act, 2009. (2) It shall come into force at once. Section 2 - Omission of sub-section (b) of Section 2 In the Uttarakhand [the Uttaranchal {the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Act, 1953} Adaptation and Modification Order, 2002] Adaptation and Modification Order, 2007 (hereinafter called principal Act) sub-section (b) of Section 2 shall be deleted. Section 3 - Omission of Sections 3 and 4 Sections 3 and 4 of the principal Act shall be deleted. Title: Declaration of Controlled Areas and Fixing of Prices

(1) The1[State Government] may, by notification in the2[Official Gazette], declare any areas specified in the notification to be a controlled area for the purposes of this Act. (2)3[* * * *] The1[State Government] may, by notification in the2[Official Gazette], fix a minimum price or minimum prices for the purchase in any controlled area of sugar cane intended for use in any factory. (3) The1[State Government] may, by notification in the2[Official Gazette] prohibit in any controlled area the purchase of sugar cane intended for use in any factory otherwise than from the grower of the sugarcane or from a person licensed by the1[State Government] to act as a purchasing agent. ________________________ 1.
