[Act, No. 35 of 1964]1 [14th August, 1964] PREAMBLE An Act to provide for the prevention of slaughter of cows, calves of cows and calves of she--buffaloes and for the preservation of other cattle in the State. WHEREAS it is expedient to provide for the prevention of slaughter of cows, calves of cows and calves of she--buffaloes and for the preservation of other cattle in the State; BE it enacted by the 2 [Karnataka State] Legislature in the Fifteenth Year of the Republic of India as follows:-- ______________________________________ 1. .....24 Indemnity No suit, prosecution or other proceedings shall lie against a servant of the State Government for any act done in good faith under this Act or the rules made thereunder. Section 25 Power to make rules (1) The State Government may make rules for carrying out the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely : (a) anything required to be prescribed under this Act ; (b) the manner in which a written order under section 7, sub-section (1) of section 9 and section 16 shall be served on the person concerned ; (c) the manner in which notices under clause (a) of sub-section (2) of section 14 shall be published ; (d) the manner in which animals should be branded or tattooed under section 8, section 11, sub-section (2) of section 13, clause (a) of sub-section (2) of section 14 and clause (a) of sub-section (3) of section 14 ; and (e) the manner in which appeals shall be filed before the Director or the Collector, as the case may be, under section 18 and section 19 and the fees to be paid for such appeals. According to the provisions of section 6 of the Maharashtra Animal Preservation Act, 1976, Bovines (bulls, bullocks, female buffaloes and buffalo calves) are prohibited for slaughter. "Slaughter" means killing to obtain flesh for butcher's meat. (b) "essential commodity" means a commodity specified in Part I of the Schedule; NOTES "Essential commodities" are restricted to the commodities like bricks used for building purposes, as Asbestos Cement Sheets, Tea and Coffee, Hair oils, Vegetables, Umbrellas, Chillies and Onions. (c) "notified order" means an order notified in the Official Gazette.

Maharashtra Animal Preservation Act, 1976 Complete Act

.....under this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code. SECTION 13: PROTECTION OF PERSONS ACTING IN GOOD FAITH TINDER ACT OR RULES No suit prosecution or other legal proceedings shall be instituted against any person for anything which is in good faith done or intended to be done under this Act or the rules made thereunder. SECTION 14: EXEMPTIONS UNDER THIS ACT Subject to any conditions prescribed in this behalf, this Act shall not apply to, - (a) any animal (other than cow) operated upon for vaccine, lymph or serum at any institution established, conducted or recognised by the State Government; (b) any animal (other than cow) operated upon for any experimental or research purposes at the institution referred to in clause (a); (c) any animal (other than cow) or class thereof ,- (i) slaughter of which is certified by a veterinary surgeon authorised in this behalf by the State Government to be necessary in the interest of the public health; (ii)Vol .2 F-12 which are suffering from any disease which is certified by such veterinary surgeon as being contagious and dangerous to other animals: Provided that no animal referred to.....
