Carriage of Goods by Sea Act, 1925 Complete Act

.....(b) fire. unless caused by the actual fault or privity of the carrier: (c) perils, dangers and accidents of the sea or other navigable waters: (d) act of God; (e) act of war; (f) act of public enemies: (g) arrest or restraint of princes, rulers of people, or seizure under legal process; (h) quarantine restriction; (i) act or omission of the shipper or owner of the goods, his agent, or representative; (j) strikes or lock-outs or stoppage or restraint of labour from whatever cause, whether partial or general; (k) riots and civil commotions; (1) saving or attempting to save life or property at sea; (m) wastage in bulk or weight or any other loss or damage arising from inherent defect, quality, or vice of the goods; (n) insufficiency of packing; (o) insufficiency or inadequacy of marks; (p) latent defects not discoverable by due diligence; (q) any other cause arising without the actual fault or privity of the carrier, or without the fault or neglect of the agents or servants of the carrier, but the burden of proof shall be on the person claiming the benefit of this exception to show that neither the actual fault or privity of the carrier nor the fault or neglect of the.....

The Act has been extended to the new Provinces and Merged States by the Merged States (Laws) Act, 1949 (59 of 1949), section 3, (w.e.f. 1-1-1950) and to the Union Territories of Manipur, Tripura and Vindhya Pradesh by the Union Territories (Laws) Act, 1950 (30 of 1950), section 3 (w.e.f 16-4-1950). Vindhya Pradesh now forms part of State of Madhya Pradesh -- See Act 37 of 1956, section 9(1)(e); but Manipur and Tripura are States now -- See Act 81 of 1971. It has now been extended to the Union Territories of -- (1) Goa, Daman and Diu by Reg. 12 of 1962. (2) Pondicherry by Reg. 7 of 1963 (w.e.f. 1-10-1963). (3) Lakshadweep Islands by Reg. 8 of 1965 and Act 34 of 1973. 2. Words "including the delegates representing His majesty" omitted by Act 52 of 1964, section 3 and Schedule II (w.e.f. 29-12-1964). 3. .....To meet the immediate requirements of the country soon after independence the Merchant Shipping Laws. (Extension to Acceding States and Amendment) Act, 1949 was enacted, by which the British Merchant Shipping Acts 1894 to 1938 were extended to the Acceding States (later known as Part B States) and Indian Consular Officers were empowered to perform functions in relation to Indian ships outside India and provision was made to enable Government to prescribe the proper national colours for ships registered in India, The Control of Shipping Act, 1947, was another short-term measure which continued the war-time control over Indian shipping and controlled the coastal trade by a system of licensing. This Act, which has been renewed from time to time, is due to expire on the 31st March, 1958. 3. Merchant Shipping Act, 1958 Section 352D

Title: Release of Ship, Etc.

.....upon the claim. (2) The conditions referred to in sub-section (1) are -- (a) that security which in the opinion of the High Court is satisfactory (in this section referred to as "guarantee") has previously been given whether in India or elsewhere, in respect of the said liability or any other liability incurred on the same occasion and the High Court is satisfied that if the claim is established, the amount for which the guarantee was given or such part thereof as corresponds to the claim will be actually available to the claimant; and (b) that either the guarantee is for an amount not less than the said limit or further security is given which, together with the guarantee, is for an amount not less than that limit. (3) The circumstances referred to in sub-section (1) are that the guarantee was given in a port which, in relation to the claim, is the relevant port (for as the case may be, a relevant port) and that port is in a convention country. (4) For the purposes of this section -- (a) a guarantee given by the giving of security in more than one country shall be deemed to have been given in the country in which security was lastgiven (b) any question.....

Merchant Shipping Act, 1958 Section 352N

Title: Compulsory Insurance or Other Financial Guarantee

.....of every Indian ship which maintains insurance or other financial security under sub-section (1), there shall be issued by the Director-General a certificate in such form and giving such particulars as may be prescribed. (3) On an application by the owner or agent of any foreign ship, the Director-General may issue a certificate under sub-section (2) in respect of such foreign ship on production of satisfactory evidence relating to maintenance of insurance or other financial security in accordance with the provisions of the International Convention on Civil Liability for Oil Pollution Damage signed at Brussels on the 29th day of November, 1969 5 [as amended from time to time]. Merchant Shipping Act, 1958 Section 352O

Title: Acceptance of Certificates Issued Outside India

Any certificate issued by a competent authority in any country outside India to a ship registered in that country or any certificate issued by a competent authority of any country which is a contracting party to the International Convention on Civil Liability for Oil Pollution Damage signed at Brussels on the 29th day of November, 19691[as amended from time to time] to any ship wherever registered, shall be accepted at any port or place in India as if it were issued under this Act. ________________________ 1.
