Government of India Act, 1935 [Repealed] Section 111

.....of entry. (3) Notwithstanding anything in this section, if the Governor-Generalor, as the case may be, the Governor of any Province, by public notificationcertifies that for the prevention of any grave menace to the peace ortranquillity of any part of India or, as the case may be, of any part ofthe Province, or for the purpose of combating crimes of violence intendedto overthrow the Government, it is expedient that the operation of theprovisions of sub-section (1) of this section should be wholly or partiallysuspended in relation to any law, then while the notification is in forcethe operation of those provisions shall be suspended accordingly. The functions of the Governor-General and a Governor under this subsection shall be exercised by him in his discretion. _________________________ 1. INDIAN COUNCILS ACT, 1871 Section 2

Title: Committal of defendant (being an European 'British subject) to the High Court (Indian Act No. 25 of 1861, s. 226)

When evidence has been given in any proceeding under this Act before a magistrate, being a Justice of the peace, which appears to be sufficient for the conviction of the accused person, being an European British subject, of an offence for which, if a native, he would under existing law be triable exclusively before the Court of Session, or which, in the opinion of the Magistrate, is one which ought to be tried by the High Court, the accused person, if such European British subject, shall be sent for trial by the Magistrate before the High Court.

Title: Power to Local Legislatures to Confer Jurisdiction over European British Subjects to Magistrates in Certain Cases

No law or regulation heretofore made or hereafter to be made by any Governor or Lieutenant-Governor in Council in India in manner prescribed by the aforesaid Act shall be invalid only by reason that it confers on magistrates, being justices of the peace, the same jurisdiction over European British subjects as such Governor or Lieutenant-Governor in Council, by regulations made as aforesaid, could have lawfully conferred or could lawfully confer on magistrates in the exercise of authority over natives in the like cases.

.....if his mother was, at the time when he was born, a British subject by virtue of section 1 (1)-of this Act. SECTION 05: CITATION, SUPPLEMENTAL PROVISIONS AND COMMENCEMENT (1) This Act may be cited as the British Nationality Act, 1965, and this Act and the British Nationality Act, 1948 to; 1964 may be cited as the British Nationality Acts, 1948 to 1965. (2) In this Act "the Principal Act" means the British Nationality Act. 1948. and the supplemental provisions contained in Sections 26 to 30,32 and 33 of that Act shall have effect For the purposes of this Act as they have effect for the purposes of that Act. (3) Any reference in this Act to a provision of the Principal Act shall, unless the context otherwise requires, be construed as a reference to that provision as amended by any other enactment. .....as the repeal of certain British statutes is concerned. As respects the recommendations relating to the replacement of certain British statutes by Acts of Parliament, the Merchant Shipping Act, 1958. has already replaced all the British statutes on that subject and many of the remaining Acts are under separate examination. 2. The reasons for repealing most of the British statutes are contained in the comments of the Commission in Appendix II at pp. 33-84 of its Fifth Report. The present Bill, however, includes a few British statutes which the Fifth Report has listed in Appendix III as statutes with respect to which legislation in India appears to be prima facie necessary. The examination of these Acts has revealed that they may also be repealed. The notes explain the reasons for including such statutes in the present Bill. 3. Clause 3 of the Bill introduces a saving provision on the lines recommended in paragraph 15 of the Report in order to make it clear that the repeal cannot possibly affect any privileges to which India and her citizens may be entitled under any statute now sought to be repealed in its application to territories outside India to which the India.....
