.....PRIVATE LOTTERY TICKETS) ACT, 1993 THE SIKKIM LOTTERIES (PROHIBITION ON RUNNING OF & SALE OF SINGLE DIGIT & PRIVATE LOTTERY TICKETS) ACT, 1993 (ACT NO. 10 of 1993) AN ACT to prohibit running of or sale of single digit lottery and private lottery tickets in the State of Sikkim. Whereas it has come to the notice of the State Government that the business of single digit lottery tickets in the State has been having serious social and economic impact detrimental to the society in general; And whereas there has been a serious adverse effect on public order on account of the said lottery business; And whereas in view of the above it is deemed expedient to stop the business of single digit lottery as well as private lotteries in the State. Be it enacted by the Legislative Assembly of Sikkim in the Forty. fourth Year of the Republic of of India as follows : I. (I) This Act may be caned the Sikkim Lotteries (Prohibition on Running of and Sale of Single Digit and Private Lottery Tickets) Act, 1993. Title: Penalty for Transfer of Tickets

.....a railway servant or an agent authorised in this behalf, he shall be punishable with imprisonment for a term which may extend to three months and with fine which may extend to five hundred rupees and if the purchaser or holder of any ticket aforesaid travels or attempts to travel therewith, he shall forfeit the ticket which he so purchased or obtained and shall be deemed to be travelling without a proper ticket and shall be liable to be dealt with under section 138: Provided that in the absence of special and adequate reasons to the contrary to be mentioned in the judgment of the court, the punishment under sub-section (1) or sub-section (2) shall not be less than a fine of two hundred and fifty rupees.

Title: Penalty for Travelling Without Pass or Ticket and for Dereliction of Duty on the Part of Conductor and Refusal to Ply Contract Carriage Etc.

.....wilfully or negligently,- (i) fails or refuses to accept the fare when tendered, or (ii) fails or refuses to supply a ticket, or (iii) "supplies an invalid ticket, or (iv) supplies a ticket of a lesser value, or (b) to check any pass or ticket, either wilfully or negligently fails or refuses to do so, he shall be punishable with fine which may extend to five hundred rupees. (3) If the holder of a permit or the driver of a contract carriage refuses, in contravention of the provisions of this Act or rules made thereunder, to ply the contract carriage or to carry the passengers, he shall,- (a) in the case of two-wheeled or three-wheeled motor vehicles, be punishable with fine which may extend to fifty rupees; and (b) in any other case, be punishable with fine which may extend to two hundred rupees.

Title: Prohibition Against Travelling Without Pass or Ticket

No person shall enter or remain in any stage carriage for the purposes of travelling therein unless he has with him a proper pass or ticket: Provided that where arrangements for the supply of tickets are made in the stage carriage by which a person has to travel, a person may enter such stage carriage but as soon as may be after his entry therein, he shall make the payment of his fare to the conductor or the driver who performs the functions of a conductor and obtain from such conductor or driver, as the case may be, a ticket for his journey. Explanation. -In this section,- (a) "pass" means a duty, privilege or courtesy pass entitling the person to whom it is given to travel in a stage carriage gratuitously and includes a pass issued on payment for travel in a stage carriage for the period specified therein; (b) "ticket" includes a single ticket, a return ticket or a season ticket.

.....purpose,-- (i) in cases where the loan exceeds two hundred and fifty rupees, unless the applicant executes a bond with two sureties, to the satisfaction of the pawn--broker or of such authority or person as may be prescribed in this behalf, agreeing to indemnify the pawnbroker in respect of any liability which may be incurred by him by reason of delivering the pledge or otherwise acting in conformity with the declaration; and (ii) in all cases, unless the declaration is duly made and delivered back to the pawnbroker within such period after the delivery of the form to the applicant, as may be prescribed; (c) The pawnbroker is hereby indemnified for not delivering the pledge to any person until the expiration of the period aforesaid. (d) The pawnbroker is hereby further indemnified for delivering the pledge or otherwise acting in conformity with the declaration unless, he has had notice within the meaning of the Transfer of Property Act, 1882 (Central Act IV of 1882), that the declaration was fraudulent or was false in any material particulars. Title: Supply of Tickets on Payment of Fare

(1)Any person desirous of travelling on a railway shall, upon payment of the fare,be supplied with a ticket by a railway servant or an agent authorised in thisbehalf and such ticket shall contain the following particulars, namely:-- (i)the date of issue; (ii)the class of carriage; (iii)the place from and the place to which it is issued; and (iv)the amount of the fare. (2)Every railway administration shall display the hours during which bookingwindows at a station shall be kept open for the issue of tickets to passengers. (3)The particulars required to be specified on a ticket under clauses (ii) and(iii) of sub-section (1) shall,-- (a)if it is for the lowest class ofcarriage, be set forth in Hindi, English and the regional language commonly inuse at the place of issue of the ticket; and (b)if it is for any other class ofcarriage, be set forth in Hindi and English: Providedthat where it is not feasible to specify such particulars in any such languagedue to mechanisation or any other reason, the Central Government may exempt suchparticulars being specified in that language.

Title: Levy of Excess Charge and Fare for Travelling Without Proper Pass or Ticket or Beyond Authorised Distance

.....or sub-section (2), as the case may be, or fifty rupees, whichever is more: Provided that if the passenger has with him a certificate granted under subsection (2) of section 55, no excess charge shall be payable. (4) If any passenger liable to pay the excess charge and the fare mentioned in sub-section (1), or the excess charge and any difference of fare mentioned in sub-section (2), fails or refuses to pay the same on a demand being made therefor under one or other of these sub-sections, as the case may be, any railway servant authorised by the railway administration in this behalf may apply to any Metropolitan Magistrate or a Judicial Magistrate of the first or second class, as the case may be, for the recovery of the sum payable as if it were a fine, and the Magistrate if satisfied that the sum is payable shall order it to be so recovered, and may order that the person liable for the payment shall in default of payment suffer imprisonment of either description for a term which may extend to one month but not less than ten days. (5) Any sum recovered under sub-section (4) shall, as and when it is recovered, be paid to the railway administration.

Title: Provision for Case in Which Ticket is Issued for Class or Train Not Having Accommodation for Additional Passengers

(1) A ticket shall be deemed to have been issued subject to the condition of availability of accommodation in the class of carriage and the train for which the ticket is issued. (2) If no accommodation is available in the class of carriage for which a ticket is issued, and the holder thereof travels in a carriage of a lower class, he shall, on returning such ticket, be entitled to a refund of the difference between the fare paid by him and the fare payable for the class of carriage in which he travels.

Title: Fraudulently Travelling or Attempting to Travel Without Proper Pass or Ticket

.....fare from the station from which the train originally started, or if the tickets of passengers travelling in the train have been examined since the original starting of the train, the ordinary single fare from the place where the tickets were so examined or, in case of their having been examined more than once, were last examined. (3) The excess charge referred to in sub-section (2) shall be a sum equal to the ordinary single fare referred to in that sub-section or fifty rupees, whichever is more. (4) Notwithstanding anything contained in section 65 of the Indian Penal Code (45 of 1860), the court convicting an offender may direct that the person in default of payment of any fine inflicted by the court shall suffer imprisonment for a term which may extend to six months.

Title: Issue or Production of Tickets

(1) Every pilgrim travelling on a pilgrim ship shall be entitled, on payment of his passage money and fulfilment of other prescribed conditions, if any, to receive a ticket in the prescribed form, and shall be bound to produce it to such officers and on such occasions as may be prescribed and otherwise to deal with it in the prescribed manner: Provided that no pilgrim, who has not been exempted under the proviso to section 273, shall be given a ticket other than a return ticket unless he has made the deposit required by that section. (2) Any ticket issued to a pilgrim for a voyage on a pilgrim ship shall entitle him to receive food and water, on the scale and of the quality prescribed and medicines free of further charge, throughout the voyage.
