.....Jurisdiction Act, 1947 , after the date on which the administration was taken over and before the 1st January, 1950. This position is highly unsatisfactory and it is obviously desirable to assimilate the laws in force in Cooch-Behar to the laws in force in the rest of West Bengal. Hence, this Bill. 2. This Bill covers matters relating to the Union and Concurrent Lists. It is clear that a complete assimilation of laws can only be effected by simultaneous legislation by the Centre and the State of West Bengal. It is also desirable that the Central Act and the State Act should come into force on the same day. Necessary steps are being taken in this behalf and the Government of West Bengal will be requested to bring their corresponding legislation into force on the 'appointed Day'." -Gaz. of ind. 12-8-1950, Part II S.2, p. 301. .....manner hereinafter appearing; It is hereby enacted as follows: Section 1 Short title This Act may be called the Cooch Behar Municipal (Amendment) Act, 1962. Section 2 Substitution of new section for section 110 of Cooch Behar Act 3 of 1944 For section 110 of the Cooch Behar Municipal Act, 1944 (hereinafter referred to as the said Act), the following section shall be substituted, namely: "110. Power of Commissioners to bring suits in the event of failure to realise tax, etc., by distress. (1) In the event of failure to realise by distress and sale the whole or any part of any tax, toll, fee or rates the Commissioners may sue the persons liable to pay the same in any court of competent jurisdiction. (2) Notwithstanding any decision of any court to the contrary, any proceeding instituted in accordance with the provisions of sections 104 to 109 and pending on the date of commencement of the Cooch Behar Municipal (Amendment) Act, 1962, may be continued after such commencement and any such proceeding, or any order made, anything done or any action taken therein, shall not, in any manner, be called in question merely on the ground that the Cooch Behar Municipal (Amendment) Act,.....

.....hereinafter appearing; It is hereby enacted as follows: Section 1 Short title This Act may be called the Cooch Behar Municipal (Second Amendment) Act, 1962. Section 2 Amendment of section 4 of Cooch Behar Act 3 of 1944 In clause (2) of section 4 of the Cooch Behar Municipal Act, 1944 (hereinafter referred to as the said Act), for the words "ten feet", the words "three metres" shall be substituted. Section 3 Amendment of section 13 In section 13 of the said Act, (i) for sub-section (.1), the following sub-section shall be substituted, namely: "(1) The Magistrate in charge of the subdivision in which a Municipality is situated or any other Magistrate of the first or second class authorised by him in writing in this behalf shall prepare and publish at the time and in the manner prescribed an electoral roll showing the names of persons qualified to vote at an election of Commissioners."; (ii) in sub-section (5), for the words "Commissioners at a meeting" the words "Magistrate by whom the electoral rolls were prepared and published under sub-section (1)" shall be substituted; and (iii) after sub-section (5), the following sub-section shall be inserted, namely: "(6) The cost.....

Title: Assimilation of Laws

(1) Save as provided in sub-section (2), all laws which immediately before the appointed day extend to, or are in force in, the State of West Bengal, but do not extend to, or are not in force in, Cooch-Behar shall, as from that day, extend to, or as the case may be, come into force in, Cooch-Behar; and all laws which, immediately before the appointed day, are in force in Cooch-Behar, but not in the rest of West Bengal, shall on that day cease to be in force in Cooch-Behar, except as respects things done or omitted to be done before that day. (2) Notwithstanding anything contained in sub-section (1), the Muslim Personal Law (Shariat) Application Act, 1937 (XXVI of 1937) shall come into force in Cooch-Behar only on such date as the State Government may, by notification in the Official Gazette, appoint; and Cooch-Behar Act 1 of 1897, known as the Muhammad an Inheritance Act, 1897, shall continue in force in Cooch-Behar until that date, and shall on that date cease to be in force except as respects things done or omitted to be done before that date.

Cooch Behar Disturbances Enquiry Act, 1951 Complete Act

.....Officer referred to in section 2 shall subject such person to, or be used against such person in any civil or criminal proceedings : Provided that such statement (a) is one which the said Judicial Officer permits or requires to be made before him by such person; and (b) is relevant to the subject-matter of the enquiry. Section 4 Savings Any power exercised, any action taken or anything whatsoever done under any provision of the Cooch Behar Disturbances Enquiry Ordinance, 1951, shall, on the said Ordinance ceasing to operate, be deemed to have been exercised, taken or done under the corresponding provision of this Act as if this Act had commenced on the 12th day of June, 1951. In this Act,-- (a) "Appointed day" means the date appointed under sub-section (2) of section 1 for the coming into force of this Act; (b) "Cooch-Behar" means the merged territory of Cooch-Behar in the State of West Bengal; (c) "Law" means so much of any Act, Ordinance, Regulation, Rule, Order or Bye-law as relates to any of the matters enumerated in Lists I and III in the Seventh Schedule to the Constitution.

Explanation. "Law" shall include any enactment, Ordinance, regulation, order, bye-law, rule, scheme, notification or other instrument having the force of law. Section 4 Legal proceedings Where immediately before the coming into force of this Act any legal proceedings are pending to which the Deputy Commissioner or the Additional Deputy Commissioner of the district of Darjeeling, Jalpaiguri, Cooch Behar or Purulia is a party, then, for the purposes of those proceedings, any reference to the Deputy Commissioner or the Additional Deputy Commissioner of the district of Darjeeling, Jalpaiguri, Cooch Behar or Purulia shall be construed as a reference to the District Magistrate and Collector or the Additional District Magistrate and Additional Collector of the district of Darjeeling, Jalpaiguri, Cooch Behar or Purulia, as the case may be.
