Prevention and Control of Infectious and Contagious Diseases in Animals Act 2009 Chapter II

Title: Control of Scheduled Diseases

.....or the village panchayat, in charge of any animal which he or it has reason to believe to be infective of a scheduled disease shall report the fact to the Village Officer or village panchayat in-charge, who may report the same in writing to the nearest available Veterinarian. (2) The Village Officer shall visit the area falling within his jurisdiction for reporting any outbreak of the disease. (3) Every Veterinarian shall, on receipt of a report under sub-section (1), or otherwise, if he has reason to believe that any animal is infected with a scheduled disease, report the matter to the Veterinary Officer. (4) Where in any State there is any occurrence of scheduled disease in relation to any animal, the Director shall send an intimation to the Directors of the States which are in the immediate neighbourhood of the place where there is such occurrence, for taking appropriate preventive measures against the spread of the disease. Section 5 - Duty to segregated infected animals (1) Every owner or person in charge of an animal, which he has reason to believe is infective of a scheduled disease, shall segregate such animal and have it kept in a place away from all.....

Title: Power to Declare Insect Pests, Plant Diseases and Noxious Weeds and Direct Measures to Eradicate or Prevent Them

.....affecting animals. INTRODUCTION In order to provide for the prevention and control of contagious diseases affecting animals, the above mentioned Act had been passed. The Act is an enabling Act which is applied to any local area during the course of an outbreak of any of the diseases, scheduled under the Act, in a virulent form and its application is withdrawn from the area as soon as the disease is under control. WHEREAS it is expedient to provide for 3[the eradication, prevention and control of diseases] affecting animals; It is hereby enacted as follows: - ________________________________ 1. .....been called upon to treat an animal, which he has reason to believe to be infected with contagious or infectious disease, shall forthwith report the fact to the Inspector having jurisdiction in the area. Section 17 - Duty to segregate infective animals Every owner or person in charge or having control of an animal, which he has reason to believe to be an infective animal, shall, as far as may be possible, segregate such animal in a place apart from all other animals which are not infective and shall take all possible steps to prevent any animal which is not infective from coming into contact with or approaching near such animal. Title: Notification by the State Government of Areas Affected by Pests, Plant Diseases or Noxious Weeds

.....the State Government may, by notification, declare such area to be an affected area for such period as may be specified in such notification; and with reference to such area the State Government may by such notification also,- (a) declare any disease, parasite, pest or weed to be a plant disease, parasite, pest or noxious weed for purposes of this Act; (b) prohibit or restrict the movement or removal of any plant, soil or manure from one place to another or prescribe such other preventive or remedial measures as may be necessary in respect of such pest, disease or weed; (c) direct that such preventive or remedial measures as may be specified shall be carried out to eradicate, destroy or prevent the introduction, spread or reappearance of any noxious weed, parasite, pest, or plant disease; and (d) prohibit the plantation or growing of any plant within such area as may be specified, which is likely to be injurious to the other crops in the area so specified.
