(1) The Registrar, or where the State Government appoints any other person in this behalf, such person, shall be the Trustee for the purpose of securing the fulfilment of the obligations of the1[State Agriculture and Rural Development Bank] to the holders of debentures issued by the Board. (2) The powers and functions of the Trustee shall be governed by the provisions of this Act and by the instrument of trust executed between the Bank and the Trustee as modified from time to time by mutual agreement between the Board and the Trustee. _____________________ 1. Title: Power of Board or of Trustee to Distrain and Sell Property, Etc

(1) The Board or the Trustee may direct the committee of an 1 [Agriculture and Rural Development Bank] to take action against a defaulter under section 88, section 89 or section 90 and if the committee neglects or fails to do so, the Board or the Trustee may take such action. (2) (a) Where such action is taken by the Board, the provisions of this Chapter and of any rules or regulations made in this behalf shall apply in respect thereto as if all references to the 1 [Agriculture and Rural Development Bank] and to its Committee in the said provisions were references to the 1 [State Agriculture and Rural Development Bank] and the Board, respectively. (b) Where such action is taken by the Trustee, the provisions of thisAct and of any rules or regulations made thereunder shall apply in respect thereto as if all references to the 1 [Agriculture and Rural Development Bank] or to its committee in the said provisions were references to the Trustee. ______________________ 1. Title: Relief to Agents and Trustees

Where any person, by reason of his receiving rent of immovable property as a receiver, agent or trustee, or of his being as a receiver, agent or trustee the person who would receive the rent if the property were let to a tenant, would under this Act or any rule or regulation made thereunder, be bound to discharge any obligation imposed on the owner of the property for the discharge of which money is required, he shall not be bound to discharge the obligation unless he has, or but for his own improper act or default might have had funds in his hands belonging to the owner sufficient for the purpose. (2) The burden of proving any fact entitling a receiver, agent or trustee to relief under sub-section (1) shall lie upon him. (3) Where any receiver, agent or trustee has claimed and established his right to relief under this section, the Board may by notice in writing require him, to apply to the discharge of his obligation as aforesaid the first moneys which may come to his hands on behalf, or for the use, of the owner, and on failure to comply with the notice, he shall be deemed to be personally liable to discharge the obligation.

Title: Meetings of Trustee Committee

(1) The trustee committee shall meet at least once in three months or more often if found necessary to transact business under this Act or the rules made thereunder. (2) Three members of the trustee committee shall form the quorum for a meeting of the committee. (3) The Chairman or in his absence, a member elected by the members present shall preside over a meeting of the trustee committee. (4) Any matter coming before a meeting of the trustee committee shall be decided by a majority of the members present and voting at the meeting and, in the case of an equality of votes, the Chairman or the member presiding over the meeting shall have a casting vote.

Title: Disqualification and Removal of Nominated Members of Trustee Committee
State: Karnataka
Year: 1983
(1) A member nominated under clause (c) or clause (d) of sub-section (3) of section 4, shall be disqualified to be a member of the trustee committee, if he,- (a) becomes of unsound mind; or (b) is adjudged an insolvent; or (c) is absent without leave of the trustee committee, for more than three consecutive meetings thereof; or 1[(d) has committed breach of trust; or] (e) is convicted by a criminal court for an offence involving moral turpitude, unless such conviction has been set aside by a competent court. (2) The State Government may remove any member who is or has become disqualified under sub-section (1) from membership of the trustee committee: Provided that no order removing any member shall be passed unless that member and the Bar Council, in the case of a member nominated by it, have been given an opportunity of being heard. _______________________ 1. Title: Annual Statement by Trustees

(1) The aforesaid trustees shall, at the end of every year submit to the corporation a statement showing,- (a) the amount which has been invested during the year under section 160; (b) the date of the last investment made previous to the submission of the statement; (c) the aggregate amount of the securities then in their hands; and (d) the aggregate amount which has, up to the date of the statement, been applied under section 161 in or towards discharging loans. (2) Every such statement shall be laid before the corporation and published.
