.....committed in respect of any such case, whether the same shall amount to the offence of murder or of man slaughter, or of being accessory before the fact to murder, or after the fact to murder or manslaughter, may be dealt with, inquired of, tried, determined, and punished in such colony, in the same manner and in all respects as if such offence had been wholly committed in that colony: and if any person in any colony shall be charged with any such offence as aforesaid in respect of the death of any person who, having been feloniously stricken, poisoned or otherwise hurt, shall have died of such stroke, poisoning, or hurt, upon the sea, or in any haven, river, creek or place where the admiral or admirals have power, authority or jurisdiction, such offence shall be held for the purpose of this Act to have been wholly committed upon the sea. .....of any lands belonging6[to such Government].]State Amendments SECTION 04: PROSECUTION OF ACCOUNTANTS AND SURETIES The person or persons at the head of the office to which any public accountant belongs may proceed against any such public accountant and his sureties for any loss or defalcation in his accounts, as if the amount thereof were an arrear of land-revenue due to Government. SECTION 05: ENACTMENTS APPLIED TO PROCEEDINGS BY AND AGAINST ACCOUNTANTS All Regulations and Acts now or hereafter to be in force for the recovery of arrears of land -revenue due to Government, and for recovery of damages by any person wrongfully proceeded against for any such arrears shall apply, with such changes in the forms of procedure as are necessary to make them applicable to the case, to the proceedings against and by such public accountant. JUDICIAL OFFICERS' PROTECTION ACT, 1850 JUDICIAL OFFICERS' PROTECTION ACT, 1850 An Act for the protection of Judicial Officers. Preamble.- For the greater protection of Magistrates and others acting judicially; It is enacted as follows:- SECTION 01: NON-LIABILITY TO SUIT OF OFFICERS ACTING JUDICIALLY, FOR OFFICIAL ACTS DONE IN GOOD FAITH, AND OF OFFICERS EXECUTING WARRANTS AND ORDERS No Judge, Magistrate, Justice of the Peace, Collector or other person acting judicially shall be liable to be sued in any Civil Court for any act done or ordered to be done by him in the discharge of his judicial duty, whether or not within the limits of his jurisdiction : Provided that he at the time in good faith, believed himself to have jurisdiction to do or order the act complained of; and no officer of any Court or other person, bound to execute the lawful warrants or orders of any such Judge, Magistrate, Justice of the Peace, Collector or other person acting judicially shall be liable to be sued in any Civil Court, for the execution of any warrant or order, which he would be bound to execute, if within the jurisdiction of the person issuing the same. SECTION 02: ARTICLES OF CHARGE TO BE DRAWN OUT FOR PUBLIC INQUIRY INTO CONDUCT OF CERTAIN PUBLIC SERVANTS Whenever the Government shall be of opinion that there are good grounds for making a formal and public inquiry into the truth of any imputation of misbehaviour by any person in the service of6[the Government, not removable from his appointment without the sanction of the Government,] it7[may] cause the substance of the imputations to be drawn into distinct articles of charge, and7[may] order a formal and public inquiry to be made into the truth thereof. SECTION 03: AUTHORITIES TO WHOM INQUIRY MAY BE COMMITTED NOTICE TO ACCUSED The inquiry may be committed either to the Court, Board or other authority to which the person accused is subordinate, or to any other person or persons, to be specially appointed by the Government, commissioners for the purpose notice of which commission shall be given to the person accused ten days at least before the beginning of the inquiry. WHEREAS it is enacted by section 9, Regulation VII, 1832 of the Bengal Code, that "whenever in any civil suit the parties to such suit may be of different persuasions, when one party shall be of the Hindu and the other of the Muhammadan persuasion, or where one or more of the parties to the suit shall not be either of the Muhammadan or Hindu persuasions the laws of those religions shall not be permitted to operate to deprive such party or parties of any property to which, but for the operation of such laws, they would have been entitled"; and whereas it will be beneficial to extend the principle of that enactment throughout1[lndia]; It is enacted as follows:- SECTION 01: LAW OR USAGE WHICH INFLICTS FORFEITURE OF, OR AFFECTS, RIGHTS ON CHANGE OF RELIGION OR LOSS OF CASTE TO CEASE TO BE ENFORCED So, much of any law or usage now in force within4[India] as Inflicts on any person forfeiture of rights or property, or may be held in any way to impair or affect any right of inheritance, by reason of his or her renouncing, or having been excluded from.....
