THE PUNJAB ADVOCATES WELFARE FUND ACT, 2002 THE PUNJAB ADVOCATES WELFARE FUND ACT, 2002 [ Act No. 4 of 2002] [ 15th January, 2002] PREAMBLE An Act to provide for the constitution of a Fund and utilisation thereof for promotion of welfare of the Advocates belonging to the State of Punjab and for the matters connected therewith or incidental thereto. Be it enacted by the Legislature of the State of Punjab in the Fifty-second Year of the Republic of India as follows :- Section 1 - Short title and commencement (1) This Act may be called the Punjab Advocates Welfare Fund Act, 2002. (2) It shall come into force at once. Section 2 - Definitions In this Act, unless the context otherwise requires, - (a) "Advocate" means a person whose name has been entered in the roll of Advocates prepared and maintained by the Bar Council of Punjab and Haryana under section 17 of the Advocates Act, 1961 and who is practicing as an Advocate and is a member of Bar Association; (b) "Bar Association" means an association of Advocates, recognised by the Bar Council under section 14; (c) "Bar Council" means the Bar Council for the States of Punjab Haryana and Union.....

.....proceedings shall lie against any officer or any other public servant for anything which is done in good faith or purported to be done under this Act or rules made thereunder. Officers to be public servant. 12. Every officer of the State Government acting under the provisions of this Act shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code, 1860. Recovery of dues. 13. Every amount due under the provision of this Act shall be recoverable as an area of public due under the provisions of the Sikkim Public Demand Recovery Act, 1988. Powers to remove Difficulties. 14. If any difficulty arises in giving effect to the provisions of this Act, the same shall be referred to the State Government for decision. Power to exempt. 15. If, in the opinion of the State Government, the enforcement of all or any of the provisions of this Act will cause hardship in any case or cases, the State Government may, by notification, setting out the grounds thereto, exempt permanently or for a specified period, such case or cases from all or any of the provisions of this Act, subject to such conditions, if any, as the State Government may deem fit to impose. 16......

(2) Where the Chairperson or a Vice-Chairperson of the Committee is removed under Sub-section (1), he shall also cease to be a member of the Committee. Section 15 - Filling of a Casual vacancy (1) When the seat of a member becomes vacant by his removal, resignation, death or otherwise, a new member shall be nominated or elected, as the case may be, in his place and such member shall hold office so long as the member whose place he fills would have been entitled to hold office if such vacancy had not occurred. Title: Vesting of Properties and Other Rights, Etc., in Committees

.....as were immediately before such commencement in the ownership, power or control of Haj Committee, Mumbai, constituted under the Haj Committee Act, 1959 and all books of account, registers and all other documents of whatever nature relating thereto shall vest absolutely in and belong to the Committee. (2) On and from the commencement of this Act, all assets, rights, leaseholds, powers, authorities and privileges and all properties, movable and immovable, including lands, buildings, stores, cash balances, cash on hand, reserve funds, investments and all other rights and interests in or arising out of such properties as were immediately before such commencement in the ownership, power or control of Haj Committee of a State and, all books of account, registers and all other documents of whatever nature relating thereto shall vest absolutely in and belong to the Haj Committee of a State. (3) All debts, obligations and liabilities incurred, all contracts entered into and all matters and things engaged to be done by with or for the Committee or a State Committee immediately before such commencement for or in connection with the purposes of the Committee or a State Committee.....

Title: Provisions as to Employees of the Existing Committee Before the Commencement of This Act

.....or the State Committee as the case may be, with such designation as such Committee may determine and shall hold office or service therein by the same tenure, at the same remuneration, upon the same terms and conditions of service as he would have held under the Haj Committee constituted under the Haj Committee Act, 1959 and shall continue to do so as an officer or other employee of the Committee till such time the terms and conditions are duly altered by such Committee: Provided that the tenure, remuneration and terms and conditions of service of any such officer or other employees of the Committee or of a State Committee, as the case may be, shall not be altered to his disadvantage without the previous sanction of the Central Government or State Government, as the case may be: Provided further that any service rendered by any such officer or other employee before the commencement of this Act shall be deemed to be the service rendered under the Committee or, as the case may be, the State Committee.

Title: Appointment of Standing Committees and Sub-committees

(1) The Committee shall appoint two Standing Committees, each headed by a Vice-Chairperson of the Committee, to deal with matters relating to finance and Haj arrangements, from amongst its members consisting of such number of members and with such powers and functions as may be determined by bye-laws made in this behalf by the Committee; Provided that the Chairperson shall preside over the meeting of the Standing Committee in case he attends the meeting. (2) The Committee may also appoint other sub-committees for such purposes as it may think fit and any such sub-committee shall consist of such number of members and other persons as may be determined by bye-laws made in this behalf by the Committee.

Title: Establishment and Incorporation of State Haj Committee

(4) An agreement under this section shall be published, in a case referred to in Clause (a) of Sub-section (2), in the Official Gazette of the participating States and in a case referred to in Clause (b) of that sub-section, in the Official Gazette of the participating Union territory or Union territories and participating State or States. (5) Any reference in this Act to the State Committee shall, unless the context otherwise requires, be construed as including a Joint State Committee.

Title: Supersession of Committee

.....shall give a reasonable opportunity to the Committee to show cause why it should not be superseded. (2) When the Committee is superseded by an order under Sub-section (1),-- (a) all members shall, on such date as may be specified in the order, vacate their offices as such members without prejudice to their eligibility for nomination under Clause (d); (b) during the period of supersession of the Committee, all powers and duties conferred and imposed upon the Committee by or under this Act shall be exercised and performed by such officer or authority as the Central Government may appoint in that behalf; (c) all property vested in the Committee shall, until it is reconstituted, vest in the Central Government; (d) before the expiry of the period of supersession, nominations shall be made by the Central Government for the purpose of reconstituting the Committee. (3) An order of supersession made under this section together with a statement of the reasons therefor shall be laid before each House of Parliament as soon as may be after it has been made.
