Carriage by Air Act, 1972 Complete Act

.....a reference to servants of the carrier. SECTION 05: LIABILITY IN CASE OF DEATH (1) Notwithstanding anything contained in the Fatal Accidents Act, 1855-or any other enactment or rule of law in force in any part of India, the rules contained in the First Schedule and in the Second Schedule shall, in all cases to which those rules apply, determine the liability of a carrier in respect of the death of a passenger. (2) The liability shall be enforceable for the benefit of such of the members of the passenger's family as sustained damage by reason of his death. (3) An action to enforce the liability may be brought by the personal representative of the passenger or by any person for whose benefit the liability is under sub-section (2) enforceable, but only one action shall be brought in India in respect of the death of any one passenger, and every such action by whomsoever brought shall be for the benefit of all such persons so entitled as aforesaid as either are domiciled in India or not being domiciled there express a desire to take the benefit of the action. (4) Subject to the provisions of sub-section (5) the amount recovered in any such action, after deducting any costs.....

.....agreed upon under the form of a single contract or of a series of contracts and it does not lose its international character merely because one contract or a series of contracts is to be performed entirely within the territory of the same State. 2. Customs Act, 1962 Chapter 11

Title: Special Provisions Regarding Baggage, Goods Imported or Exported by Post, and Stores

.....the description, quantity and value thereof, shall be deemed to be an entry for import or export, as the case may be, for the purposes of this Act. Section 83 - Rate of duty and tariff valuation in respect of goods imported or exported by post (1) The rate of duty and tariff value, if any, applicable to any goods imported by post shall be the rate and valuation in force on the date on which the postal authorities present to the proper officer a list containing the particulars of such goods for the purpose of assessing the duty thereon : Provided that if such goods are imported by a vessel and the list of the goods containing the particulars was presented before the date of the arrival of the vessel, it shall be deemed to have been presented on the date of such arrival. (2) The rate of duty and tariff value, if any, applicable to any goods exported by post shall be the rate and valuation in force on the date on which the exporter delivers such goods to the postal authorities for exportation. Commercial Documents Evidence Act, 1939 Complete Act

.....The result is that a party desirous of delaying the proceedings can often insist on the other side getting Commissions issued to take evidence as to facts which are for all practical purposes sufficiently established by the documents in question. It is proposed to undertake legislation on the lines of the Bankers Books Evidence Act, 1891, so as to provide that commercial documents which are accepted as prima facie correct in commercial circles may be admitted in evidence without formal proof. Title: Bona Fide Baggage Exempted from Duty

.....or a member of the crew in respect of which the said officer is satisfied that it has been in his use for such minimum period as may be specified in the rules ; (b) any article in the baggage of a passenger in respect of which the said officer is satisfied that it is for the use of the passenger or his family or is a bona fide gift or souvenir: Provided that the value of each such article and the total value of all such articles does not exceed such limits as may be specified in the rules. (2) The Central Government may make rules for the purpose of carrying out the provisions of this section and, in particular, such rules may specify (a) the minimum period for which any article has been used by a passenger or a member of the crew for the purpose of clause (a) of sub-section (1) ; (b) the maximum value of any individual article and the maximum total value of all the articles which may be passed free of duty under clause (b) of sub-section (1) ; (c) the conditions (to be fulfilled before or after clearance) subject to which any baggage may be passed free of duty. (3) Different rules may be made under sub-section (2) for different classes of persons.

.....to believe that any dealer has attempted to evade payment of any tax, he may issue a protective assessment on such dealer in accordance with sub-section (5) of Section 38.
