THE UNITED NATIONS (SECURITY COUNCIL) ACT, 1947 [Act, No. 43 of 1947] [AS ON 1995] [ 20th December, 1947] PREAMBLE An Act to enable effect to be given to certain provisions of the Charter of the United Nations. WHEREAS it is expedient to enable effect to be given to certain provisions of the Character of the United Nations ; It is hereby enacted as follows :-

WHEREAS it is expedient to enable effect to be given to certain provisions of the Charter of the United Nations; It is hereby enacted as follows:- SECTION 01: SHORT TITLE This Act may be called, THE UNITED NATIONS (SECURITY COUNCIL ACT, 1947. SECTION 02: MEASURES UNDER ARTICLE 41 OF THE CHARTER OF THE UNITED NATIONS If under Article 41 of the Charter of the United Nations signed at San Francisco on the 26th day of June 1945 the Security Council of the United Nations calls upon the Central Government to apply any measures, not involving the use of armed force to give effect to any decision of that Council, the Central Government may by order published in the Official Gazette, make such provisions (including provisions having extra-territorial operation) as appear to it necessary or expedient for enabling those measures to be effectively applied, and without prejudice to the generality of the foregoing power, provision may be made for the punishment of persons offending against the order. If, under Article 41 of the Charter of the United Nations signed at San Francisco on the 26th day of June 1945 the Security Council of the United Nations calls upon the Central Government to apply any measures, not involving the use armed force, to give effect to any decision of that Council, the Central Government may, by order published in the Official Gazette, make such provisions (including provision having extra-territorial operation) as appear to it necessary or expedient for enabling those measures to be effectively applied, and without prejudice to the generality of the foregoing power, provision may be made for the punishment of persons offending against the order.

WHEREAS it is expedient to provide for1[* *] control over issues of capital; It is hereby enacted as follows The Act has been extended to the new provinces and merged States bythe Merged States (Laws) Act, 1949) (59 of 1949), S. 3 (1-1- 1950) and to the Union Territories (now States) of Manipur. Tripura & Vindhya Pradesh bythe Union Territories (Laws) Act. 1950 (30 of 1950) . S. 3 (16-4-1950). Vindhva Pradesh now forms part of the State of Madhya Pradesh-See C. A. 37 of 1956. (2) Dadra and Nagar Haveli - Act as in force in the State of Gujarat is extended to this territory with effect from 1-1- 1966 - See Gazette of India. 18-12-65. Pt. II. S. 3(l). p. 2016. (3) Pondicherry. by Regn. 7 of 1963 (1-10-1963). (4) Laccadive Minicoy and Amindivi Islands by Regn. 8 of 1965 (1-10- 1967). These are now known as Lakshadweep Islands - See Act 34 of 1973. .....requires, - (a) "Company" means a company as defined in section 3 of the Companies Act, 1956, and includes a foreign company within the meaning of section 591 of that Act; (b) "issue of capital" means the issuing or creation of any securities whether for cash or otherwise, and includes the capitalization of profits or reserves for the purpose of converting partly paid-up shares into fully paid-up shares or increasing the par value of shares already issued; (c) "Private company" means a private company as defined in section 3 of the Companies Act, 1956; (d) "Prospectus" means any prospectus, notice, circular, advertisement or other document inviting offers from the public for the subscription or purchase of any securities of a company; (e) "Securities" means any of the following instruments issued or to be issued, or created or to be created, by or for the benefit of a company, namely: - (i) shares, sks and bonds; (ii) Debentures: (iii) Mortgage deeds, instruments of pawn, pledge or hypothecation and any other instruments, creating or evidencing a charge or lien on the assets of the company; and (iv) Instruments acknowledging loan to or indebtedness of the.....

Bombay Prevention of Fragmentation and Consilidation of Holdings Act, 1947 Section 29

Title: Transfer of Encumbrances

.....therefrom and attach itself to the holding allotted to him under the scheme or to such part of if as the Consolidation Officer may, subject to any rules made under section 37, appoint; and the 3[* *] mortgagee, creditor or other incumbrancer, as the case may be, shall exercise his rights accordingly. (2) If the holding to which a 1[***] mortgage, debt or other encumbrance is transferred under section (1) is of less market value than the original holding from which it is transferred the 3[* * * ] mortgagee, creditor or other encumbrancer, as the case may be, shall subject to the provisions of section 30 be entitled to the payment of such compensation by the owner of the holding, as the case may require, as the Consolidation Officer may determine. Bombay Agricultural Debtors Relief Act, 1947, (Maharashtra) Section 28

Title: Fraudulent Alienations or Encumbrances Void

(1) If in the course of the hearing of an application made under section 4, the Court finds that the debtor has made an alienation of property or created any encumbrance thereon with intent to defeat or delay any of his creditors, the Court shall, by notice, summon the debtor and the person in whose favour the alienation or encumbrance is made or created to appear before it on a day to be specified in the notice. (2) On the day specified in the notice or such other day to which the hearing may be adjourned the Court shall hear the parties 1[and record evidence as may be produced] and if it is satisfied that the alienation was made or the encumbrance was created with intent to defeat or delay any of the creditors of the debtor the Court shall declare the alienation or encumbrance to be void. (3) Nothing in this section shall impair the rights of an alienee or the holder of an encumbrance in good faith and for valuable consideration. _________________ 1.
