Textile Undertakings (Nationalisation) Act,1995 Chapter 2

Title: Acquisition and Transfer of the Textile Undertakings

.....and all other documents of whatever nature relating thereto and shall also be deemed to include the liabilities and obligations specified in sub-section (2) of section 5. (2) All property as aforesaid which have vested in the Central Government under sub-section (1) of section 3 shall, by force of such vesting be freed and discharged from any trust, obligation mortgage, charge, lien and all other incumbrances affecting it, and any attachment, injunction or decree or order of any Court or other authority restricting the use of such property in any manner shall be deemed to have been withdrawn. (3) Where any licence or other instrument in relation to a textile undertaking had been granted at any time before the appointed day to the owner by the Central Government or a State Government or any other authority, the National Textile Corporation shall on and from such date, be deemed to be substituted in such licence or other instrument in place of the owner referred to therein as if such licence or such other instrument had been granted to it and shall hold such licence or the textile undertaking specified in such other instrument for the remainder of the period for which the.....

Title: Mutawalli Not to Spend Any Money Belonging to Wakf for Self Defence

No mutawalli shall spend any money out of the funds of the wakf, of which he is the mutawalli, for meeting any costs, charges, or expenses which are or may be, incurred by him, in relation to any suit, appeal or any other proceeding for, or incidental to, his removal from office or for taking any disciplinary action against himself.

.....thinks fit for performing the functions under this Act, and such sums shall be treated as expenditure payable out of the grants referred to in sub-section (2). Section 13 - Accounts and audit (1) Accounts of the income and expenditure of the Commission shall be kept in such form as may be prescribed. (2) The Commission shall prepare an annual statement of accounts in such form as may be prescribed. (3) The Accounts of the Commission shall be audited annually by such auditor as the Government may appoint in this behalf. (4) The auditor shall for the purposes of the audit, have access to all the accounts and other records of the Commission. (5) The Commission shall pay out of the grants such charges for the audit, as may be prescribed. (6) As soon as may be, after the receipt of the report of the auditor, the Commission shall send a copy of the annual statement of accounts together with a copy of the report of the auditor to the Government and shall cause to be published the annual statement of account in such manner as may be prescribed. (7) The Government may, after perusal of the report of the auditor give such directions, as it thinks fit, to the Commission.....

(1) Accounts of the income and expenditure of the Commission shall be kept in accordance with such rules, as may be prescribed. (2) The Commission shall prepare an annual statement of accounts in such form, as may be prescribed. (3) The accounts of the Commission shall be audited annually by such auditor as the State Government may appoint. (4) The auditor shall, for the purpose of the audit, have access to all the accounts and other records of the Commission. (5) The Commission shall pay from its grant such charges for the audit, as may be prescribed. (6) A soon as may be after the receipt of the report of the auditor the Commission shall send a copy of the annual statement of accounts together with a copy of the report of the auditor to the State Government and shall cause to be published the annual statement of accounts in such manner, as may be prescribed. (7) The State Government may after perusal of the report of the auditor give such directions as it thinks fit to the Commission and the Commission shall comply with such directions.

Wakf Act, 1995 Section 76

Title: Mutawalli Not to Lend or Borrow Moneys Without Sanction

.....provision in the deed of wakf for such borrowing or lending, as the case may be. (2) The Board may, while according sanction, specify any terms and conditions subject to which the person referred to in sub-section (1) is authorised by him to lend or borrow any money or lend any other wakf property. (3) Where any money is lent or borrowed, or other wakf property is lent in contravention of the provisions of this section, it shall be lawful for the Chief Executive Officer, (a) to recover an amount equal to the amount which has been so lent or borrowed, together with interest due thereon, from the personal funds of the person by whom such amount was lent or borrowed; (b) to recover the possession of the wakf property lent in contravention of the provisions of this Act, from the person to whom it was lent, or from persons who claim title to such property through the person to whom such property was lent.
