Be it enacted by Parliament in the Fifty-ninth Year of the Republic of India as follows:-- PART I Preliminary 1. Short title and commencement (1) This Act may be called the Information Technology (Amendment) Act, 2008. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint: Provided that different dates may be appointed for different provisions of this Act and any reference in any such provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision. PART II Amendments to the Information Technology Act, 2000 2. Substitution of words "digital signature" by words "electronic signature". BE it enacted by Parliament in the Fifty-seventh Year of the Republic of India as follows:-- 1. Short title This Act may be called the Juvenile Justice (Care and Protection of Children) Amendment Act, 2006. 2. Amendment of long title In the Juvenile Justice (Care and Protection of Children) Act, 2000, 56 of 2000 (hereinafter referred to as the principal Act), in the long title, for the words "through various institutions established under this enactment", the words "and for matters connected therewith or incidental thereto" shall be substituted. 3. Amendment of section 1 In section 1 of the principal Act,-- (i) in the marginal heading, for the words "and commencement", the words "commencement and application" shall be substituted; (ii) after sub-section (3), the following sub-section shall be inserted, namely:-- "(4) Notwithstanding anything contained in any other law for the time being in force, the provisions of this Act shall apply to all cases involving detention, prosecution, penalty or sentence of.....

Substitution of new section for section 6 For section 6 of the Negotiable Instruments Act, 1881 (hereinafter referred to as the principal Act), the following section shall be substituted, namely:-- '6. "Cheque".-- A "cheque" is a bill of exchange drawn on a specified banker and not expressed to be payable otherwise than on demand and it includes the electronic image of a truncated cheque and a cheque in the electronic form. Explanation 1.--For the purposes of this section, the expressions-- (a) "a cheque in the electronic form" means a cheque which contains the exact mirror image of a paper cheque, and is generated, written and signed in a secure system ensuring the minimum safety standards with the use of digital signature (with or without biometrics signature) and asymmetric crypto system; (b) "a truncated cheque" means a cheque which is truncated during the course of a clearing cycle, either by the clearing house or by the bank whether paying or receiving payment, immediately on generation of an electronic image for transmission,.....

Amendment of section 9 In the Central Road Fund Act, 2000 (54 of 2000) (hereinafter referred to as the principal Act), namely:- (b) take such measures as may be necessary to raise funds for the development and maintenance of the national highways and for the development of rural roads;. 3. Amendment of section 11 In section 11 of the principal Act, after sub-section(1), the following proviso shall be inserted, namely:- Provided that the Central Government may use the share of the fund under sub-clause(a) of clause(viii) of section 10 for the repayment of any loan taken for the purpose of development of rural roads in any state or Union territory.

In section 234C of the Income-tax Act, 1961 (43 of 1961) (hereinafter referred to as the Income-tax Act), in sub-section (7), in clause (b), after the first proviso and before the Explanation, the following proviso shall be inserted, namely: -- "Provided further that nothing contained in this sub-section shall apply to any shortfall in the payment of the tax due on the returned income where such shortfall is on account of increase in the rate of surcharge under section 2 of the Finance Act, 2000, as amended by the Taxation Laws (Amendment) Act, 2000, (10 of 2000) and the assessee has paid the amount of shortfall, on or before the 15th day of March, 2001 in respect of the installment of advance tax due on the I5th day of June, 2000, the 15th day of September, 2000 and the 15th day of December, 2000.".
