Section 2 - Repeal The enactments specified in Schedule I are hereby repealed in the area to which this Act extends. OFFICIAL TRUSTEES ACT, 1913 OFFICIAL TRUSTEES ACT, 1913 AN ACT TO CONSOLIDATE AND AMEND THE LAW CONSTITUTING THE OFFICE OF OFFICIAL TRUSTEE. IT IS HEREBY ENACTED AS FOLLOWS:- PART -I PRELIMINARY SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Official Trustees Act, 1913. (2) It extends to the whole of India. (3) It shall come into force on such date as the Central Government, by notification in the Official Gazette may direct. SECTION 02: INTERPRETATION CLAUSE In this Act, unless there is anything repugnant in the subject or context,- (1) "Government" or "the Government" means, in relation to a Stale, the State Government and, in relation to a Union territory, the Central Government. (2)** (3) "Prescribed" means prescribed by rules under this Act. Title: Mode of Proceeding by Claimant to Recover Money So Transferred

(1) If any claim is made to any moneys so transferred and such claim is established to the satisfaction of the prescribed authority, the Government { The words "of India,, omitted by Act 21 of 1922,section4.} shall pay to the claimant the amount in respect of which the claim is established. (2) If such claim is not established to the satisfaction of the prescribed authority, the claimant may, without prejudice to his right to take any other proceedings for the recovery of such moneys, apply by petition to the High Court against the { Subs.by the A.O.1937, for "Secretary of State for India in Council".}[Government]. and, after taking such evidence as it thinks fit, such Court shall make such order on the petition in regard to the payment of such money as it thinks fit, and such order shall be binding on all parties to the proceedings.{ Proviso. ins. by the A O.1937, omitted by the A, O, 1950.} (3) The Court may further direct by whom all or any part of the costs of such proceedings shall be paid.

Subject to the provisions of this Act and the rules thereunder, the provisions of sections 79, 85, 86, 87, 89, 90, 91, 92 and 101, of the Punjab Tenancy Act, 1887, shall, so far as may be, apply to all proceedings of a Collector under this Act. Petition of redemption 4. The mortgagor or other person entitled to institute a suit for redemption may, at any time after the principal money becomes payable and before a suit for redemption is barred, present a petition to the Collector applying for an order directing that his mortgage be redeemed, and where the mortgage is with possession that he be put in possession of the mortgaged property. The petition shall be duly verified in the manner prescribed by law for the verification of plaints, and shalll state the sum which the petitioner declares to the best of his belief to be due under the mortgage.
