National Environment Tribunal Act, 1995 Complete Act

.....and received the assent of the President on 17th June, 1995 and became an Act of Parliament under the short title "THE NATIONAL ENVIRONMENT TRIBUNAL ACT, 1995 (29 OF 1995). An Act to provide for strict liability for damages arising out of any accident occurring while handling any hazardous substance and for the establishment of a National Environment Tribunal for effective and expeditious disposal of cases arising from such accident, with a view to giving relief and compensation for damages to persons, property and the environment and for matters connected therewith or incidental thereto. WHEREAS decisions were taken at the United Nations Conference on Environment and Development held at Rio de Janeiro in June, 1992, in which India participated, calling upon the States to develop national laws regarding liability and compensation for the victims of pollution and other environmental damages; AND WHEREAS it is considered expedient to implement the decisions of the aforesaid Conference so far as they relate to the protection of environment and payment of compensation for damage to persons, property and the environment while handling hazardous substances; BE it enacted by Parliament.....

National Environment Tribunal Act, 1995 Chapter IV

Title: Jurisdiction and Proceedings of the Tribunal

.....under any award by the Tribunal on the ground of any damage to environment, that amount shall be remitted to the authority specified under sub-­section (3) of section 7A of the Public Liability Insurance Act, 1991 (6 of 1991) for being credited to the Environmental Relief Fund established under that section. (2) The amount of compensation credited to the Environmental Relief Fund under sub­-section (1) may be utilised by such person or authority, in such manner and for such purposes of environment as may be prescribed. Section 23 - Execution of award or order of Tribunal (1) An award made by the Tribunal under this Act shall be executable by the Tribunal as a decree of civil court, and for this purpose, the Tribunal shall have all the powers of a civil court. (2) Notwithstanding anything contained in sub-section (1), the Tribunal may transmit to the Collector having jurisdiction over the area in which the accident has occurred the copy of the order made by it for payment of relief as provided in the Public Liability Insurance Act, 1991 and the Collector shall execute the order in the same manner as if it were an order made by him under that Act. National Environment Tribunal Act, 1995 Section 19

On and from the commencement of this Act, no court or other authority except the Tribunal shall have, or be entitled to exercise, any jurisdiction powers or authority to entertain any application or action for any claim for compensation which may be entertained or dealt with by the Tribunal.

Title: Notice of Suits by Parties Against Board

No suit shall be instituted against the Board in respect of any act purporting to be done by it in pursuance of this Act or of any rules made thereunder, until the expiration of two months next after notice in writing has been delivered to, or left at, the office of the Board, stating the cause of action, the name, description and place of residence of the plaintiff and the relief which he claims; and the plaint shall contain a statement that such notice has been so delivered or left.

Title: Admission or Rejection of Claims

..... (c) the reception of evidence on affidavits; and (d) the issuing of any commission for the examination of witnesses. (6) Any investigation before the Commissioner shall be deemed to be a judicial proceeding within the meaning of sections 193 and 228 of the Indian Penal Code and the Commissioner shall be deemed to be a Civil Court for the purposes of section 195 and Chapter XXVI of the Code of Criminal Procedure, 1973. (7) A claimant who is dissatisfied with the decision of the Commissioner may prefer an appeal against the decision to the principal Civil Court of original jurisdiction within the local limits of whose jurisdiction the textile undertaking is situated : Provided that where a person who is a Judge of a High Court is appointed to be the Commissioner, such appeal shall lie to the High Court for the State in which the textile undertaking is situated and such appeal shall be heard and disposed of by not less than two Judges of that High Court.

Textile Undertakings (Nationalisation) Act,1995 Section 20

Title: Claims to Be Made to the Commissioner

State: Central

Year: 1995

Every person having a claim against the owner of a textile undertaking shall prefer such claim before the Commissioner within thirty days from the specified date: Provided that if the Commissioner is satisfied that the claimant was prevented by sufficient cause from preferring the claim within the said period of thirty days, he may entertain the claim within a further period of thirty days but not thereafter.

Textile Undertakings (Nationalisation) Act,1995 Section 21

Title: Priority of Claims

The claims arising out of the matters specified in the Second Schedule shall has priorities in accordance with the following principles, namely : (a) category I shall have precedence over all other categories and category II shall have precedence over category III and so on; (b) the claims specified in each of the categories, except category IV, shall rank equally and be paid in full, but if the amount is insufficient to meet such claim in full, they shall abate in equal proportions and be paid accordingly; (c) the liabilities specified in category IV shall be discharged, subject to the priorities specified in this section, in accordance with the terms of the secured loans and the priority inter se of such loans; and (d) the question of payment of a liability with regard to matter specified in a lower category shall arise only if a surplus is left after meeting all the liabilities specified in the immediately higher category.

Textile Undertakings (Nationalisation) Act,1995 Section 22

Title: Examination of Claims

State: Central

Year: 1995

(1) On receipt of the claims under section 20 the Commissioner shall arrange the claims in the order of priority specified in the Second Schedule and examine the same in accordance with the said order. (2) If, on examination of the claims, the Commissioner is of the opinion that the amount paid to him under this Act is not sufficient to meet the liabilities specified in any lower category, he shall not be required to examine the liabilities in respect of such lower category.
