The Punjab Package Deal Properties (Disposal) Act 1976 Complete Act

.....entered into possession, thereof in pursuance of an order obtained by him by means of fraud, false representation or concealment of any material facts; or (c) where he, being an allottee, lessee or grantee, has by reason of the determination or cancellation of his allotment, lease or grant in accordance with the terms in that behalf therein contained, ceased, whether before , or after the commencement of this Act, to be entitled to occupy or hold such package deal property: or (d) where any person authorized to occupy any package deal property, has, whether before or after the commence of this Act - (i) sublet, in contravention of the terms of allotment, lease or grant, without the permission of the State Government or of any other authority competent to permit such sub-letting, the whole or any part of such package deal property; or (ii) otherwise acted in contravention of any of the terms, express or implied, under which he is authorized to occupy such package deal property. - Explanation- For the purpose of sub-clause (a), a person shall not merely by reason of the fact that he has paid any rent be deemed to have entered into possession as allottee lessee or.....

Section 3 - Application of the Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1973, to common purposes land Notwithstanding anything contained in any law for the time being in force, the Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1973, (hereinafter referred, to as the principal Act) shall apply to common purposes land which shall be deemed to be public premises for the purposes of the Principal Act. Section 4 - Appeal Notwithstanding anything in the principal Act, an appeal under section 9 of that Act in relation to common purposes land, shall lie to an officer not below the rank of a Joint Director of Panchayats appointed by the Government for the said purpose who shall be deemed to be the Commissioner under the principal Act. Be it enacted by the Legislature of the State of Punjab in the Twenty-seventh Year of the Republic of India, as follows :- Section 1 - Short title and commencement This Act may be called the Punjab Mechanical Vehicles (Bridge Tolls) (Repeal) Act, 1976. Section 2 - Repeal of Punjab Act 1 of 1958 The Punjab Mechanical Vehicles (Bridge Tolls) Act, 1957, is hereby repealed. Provided that such repeal shall not affect " (a) the previous operation of the Act so repealed or anything duly done or suffered there under; or (b) any obligation or liability accrued or incurred under the Act so repealed; or (c) any penalty, forfeiture or punishment incurred in respect of any offence committed against the Act so repealed; or (d) any legal proceeding or remedy in respect of any such obligation, liability, penalty, forfeiture or punishment as aforesaid; and any such legal proceeding or remedy may be continued or enforced and any such penalty, forfeiture or punishment may be imposed as if this Act had not been passed.
