The Orissa Cess Act, 1962 Complete Act

.....enactments or anything duly done or suffered or any right, privilege, obligation or lia bility acquired, accrued or incurred thereunder. (2) All rules, orders, appointments and valua tions in force it the commencement of this Act, which were made under the -said enactments shall so far as they are consistent with the provisions of this Act, be deemed to have been made under this Act. (3) Every sum due to be collected in respect of arrears of cess, of expenses incurred, of fees or cost payable, of notices served or of fines imposed under the said enactments, shall be, deemed to be due on such account under this Act; and all cess so imposed and every sum so due may be levied or realised as herein provided. 3. Definitions. In this Act, unless there is anything repug nant in the subject or context" (i) 'Collector' means the Collector of a district and includes a Deputy Commis sioner; (ii) 'estate' includes a part of an estate and - means any land held by or vested in an Intermediary and included under one entry in any revenue roll or any of the general registers of revenue paying lands and revenue-free lands, prepared and maintained under the law relating to land.....

.....of the Orissa Gazette, dated the 18th September 1962] AN ACT TO VALIDATE THE ORISSA TAXATION (ON GOODS CARRIED BY ROADS OR INLAND WATER-WAYS) ACT, 1959 Orissa Act 7 of 1959. WHEREAS the Orissa Taxation (on Goods carried by Roads or Inland Water-ways) Act, 1959, had been enacted without obtaining the previous sanction of the president of India as required under the provisions of Part XIII of the Constitution of India; AND WHEREAS in view of the recent decision of the Supreme Court, doubts have arisen regarding the validity of the said Act as amended from time to time and of the actions taken thereunder; AND WHEREAS fit is expedient that all such doubts be removed by validating the enactment of the said law as amended from time to time and the actions taken thereunder; AND WHEREAS previous sanction of the President of India has been obtained under the proviso to Article 304 (b) of the Constitution of India; It is hereby enacted by the Legislature of the State of Orissa in the Thirteenth Year of the Republic of India as follows:- Short title and extent. 1 . (1) This Act may be called the Orissa Taxation (on Goods carried by Roads or Inland Water-ways).....

In this Act, unless the context otherwise requires" (a) "appointed date" means the date appointed under sub-section (3) of section 1; (b) "emoluments" means, money salaries and all other kinds of payment or allowance by way of remuneration granted or continu ed in respect of, or annexed to, any hereditary village office; (c) "hereditary village office" means any office in the district of Ganjam known as village accountant, head of village or village watchman under the Madras Proprietary Estates Village Service Act, 1894 or any office in the said district known as village munsif, kamam, vetti or talayari under the Madras Hereditary Village Offices Act, 1895; (d) "holder of a hereditary village office" means a person holding a hereditary village office permanently or officiating in a permanent vacancy after a selection in accordance with the procedure in force immediately before the appointed date; (e) "Prescribed" means prescribed by rules made under this Act. 3. .....by rules made under this Act, determine the value or consideration and the duty as aforesaid and the deficient amount of duty, if any, shall be payable by the person liable to pay the duty.
