The Meghalaya Agricultural Produce Market Act, 1980 Complete Act

In Section 4, Clause (c), of the Legislative Assembly of Meghalaya (Members' Salaries and Allowances) Act, 1972, for the words "Senior Grade", the words and figure "Grade I" shall be substituted. STATEMENT OF OBJECT AND REASONS Due to the fact that the category of Senior Grade Government Servants has been merged with that of the First Grade after adjustment of pay ranges, the reference made to 'Senior Grade' in the Legislative Assembly of Meghalaya (Members' Salaries and Allowances) Act, 1972 in regard to the travelling allowances of the Members of the Legislative Assembly has also called for a change. Hence this Bill. FINANCIAL MEMORANDUM The proposed amendment does not involve any financial expenditure. Extract from the Meghalaya Act 8 of 1972. Allowance 4. STATEMENT OF OBJECTS AND REASONS The Bill seeks to amend the Legislative Assembly of Meghalaya (Members' Salaries and Allowances) Act, 1972 (Act, 8 of 1972) to provide that Rules made under the Act may also be made to have retrospective effect and for validation of the Rules already made with retrospective operation. Extract of Section 7 of Act 8 of 1972. Power to make rules. 4. The Government may, by notification, make rules to carry out he purposes of this Act and, in particular, may prescribe - (a) the period during which the conditions subject to which travelling allowance may be drawn and the circumstance in which such allowances may be withheld. Now therefore, in exercise of the Power conferred by Section " 3, of the Essential Commodities Act, 1955, [10 of 1955] read with the Orders of the Govt. of India in the Ministry of Agriculture (Department of Food), NO. G.S.R. 452 (E), dated the 25th October, 1972, and NO. G.S.R. 168 (E), dated the 13th March, 1973, and with prior concurrence of the Central Govt., the Governor of Meghalaya hereby makes the following Order, namely: " 01. Short title, extend and commencement: " (1) This Order may be called the Meghalaya Roller Flour Mills and Chakki Mills Wheat Products [Ex " Mill] Control Order, 1980. (2) It extends to the whole of the State of Meghalaya. (3) It shall come into force at once. 02. Definition: " In this Order, unless the context otherwise requires : " (a) "Roller Flour Mills" means a Flour Mill in which disintegration of Wheat is done by Grooved Steel or Iron Roller worked by Power. (b) "Chakki Mill" means a milling process in which disintegration of Wheat is done by Power or Diesel Engine. (c) "Wheat Products." means Suji, Maida, Atta, Wholemeal Atta and Bran produced in Roller Flour Mills and also.....

.....shall be payable to non-official members of the Committee at the highest rate admissible to the Government servants of Group ˜A' under the rules and orders made by the Central Government and for the time being in force. .....by the said sub-section. (3) When any order is made under this section by an officer mentioned in sub-section (2), he shall forthwith report the fact to the State Government to which he is subordinate together with the grounds on which the order has been made and such other particulars as in his opinion have a bearing on the matter, and, no such order shall remain in force for more than twelve days after the making thereof unless in the meantime it has been approved by the State Government: Provided that where under Section 8 the grounds of detention are communicated by the authority making the order after five days but not later than ten days from the date of detention, this sub-section shall apply subject to the modification that for the words "twelve days", the words "fifteen days" shall be substituted. (4) When any order is made or approved by the State Government under this section or when any order is made under this section by an officer of the State Government not below the rank of Secretary to that Government specially empowered under sub-section (1), the State Government shall, within seven days report the fact to the Central Government together with the grounds.....
