1) The144[Wakf Commissioner] may, either on an application received under section 44-or on145[his own motion], (a) hold an enquiry in such manner as may be prescribed; or (b) authorise any person in this behalf to hold an inquiry, into any matter relating to a wakf and take such action146[as he thinks fit].
(2) For the purposes of any inquiry under this Act,147[the Wakf Commissioner or any person authorised by him] in this behalf shall have the same powers as are vested in a civil court under the Code of Civil Procedure, 1908-for enforcing the attendance of witnesses and production of documents. 148 [(3) The Wakf Commissioner holding any inquiry under sub-section (1), shall be deemed to be a person acting judicially within the meaning of the Judicial Officers Protection Act, 1850.]
