Food, Pan masala, gutka are held to be food within the meaning of s. 2(v) of Prevention of Food Adulteration Act, 1954, Godawal Pan Masala Products Ltd. v. Union of India, (2004) 7 SCC 68 (101): AIR 2004 SC 4057. Food. In the Sale of Food and Drugs Act (see ADULTERATION) the word includes 'every article used for food or drink by man, other than drugs or water and any article which ordinarily enters into or is used in the composition or preparation of human food,' and also 'flavouring matters and condiments.'-(English) Sale of Food and Drugs Act, 1899 (62 & 63 Vict. c. 51), s. 26; (English) Public Health Act, 1925 (15 & 16 Geo. 5, c. 71), s. 72; and Food and Drugs (Adulteration) Act, 1928 (18 & 19 Geo. 5, c. 31), s. 34. Means any article of nourishment for human con-sumption and also includes any substance intend-ed for the use of infants, invalids or convalescents as an article of food or drink. [Patents Act, 1970 (39 of 1970), s. 2 (1) (g)] Means any article used as food or drink for human consumption other than drugs and water and includes: (a) any article which ordinarily enters into, or is used in the composition or preparation of, human food, (b) any flavouring matter or condiments, and (c) any other article which the Central Government may, having regard to its use nature, substance or quality, declare, by notification in the Official Gazette, as food for the purposes of this Act. [Prevention of Good Adulteration Act, 1954 (37 of 1954), s. 2 (v)] The expression 'food' has generally been understood to mean nutritive material absorbed or taken into the body of an organism which serves for purposes of growth, work or repair and for the maintenance of the vital process. What human beings consume is styled as food and what animals consume is described as animal feed. This distinction has to be borne in mind. Expression 'foodstuffs' is made of two expressions, 'food' plus 'stuff' is made of to expressions, 'food' plus 'stuff'. In other words, the stuff which is used as food would be foodstuff. Therefore, foodstuff is that which is taken into the system to maintain life and growth and to supply waste of tissue. If the raw foodstuff with a view to making it consumable by human beings undergoes a change of its conditions by the process of cooking, the derivative is none the less foodstuff, Welcome Hotel v. State of Andhra Pradesh, AIR 1983 SC 1015: (1983) 4 SCC 575: (1983) 3 SCR 674. Means the composite preparations which normally go to constitute a meal - curry and rice, sweetmeats, pudding, cooked vegetables and so forth, Collector of Central Excise v. Parle Exports (P) Ltd., AIR 1989 SC 644: (1989) 1 SCC 345: (1988) Supp 3 SCR 933. The word 'food' is a very general term and applies to all that is eaten by men for nourishment and taken in subsidiaries. Supari eaten with relish by men for taste and nourishment and so it is food. Supari is food within the meaning of s. 2(v) of the Act, Pyarali K. Tejani v. Mahadeo Ramachandra Dange, AIR 1974 SC 228 (234). [Prevention of Food Adulteration Act, 1954, s. 2 (v)] Means any article of nourishment for human consumption and also includes any substance intended for the use of infants, invalids or convalescents as an article of food or drink. [Patents Act, 1970 (39 of 1970), s. 2(1) (g)] Is defined to mean as a substance which is taken into the body to maintain life and growth, Swastik Udyog v. Commissioner of Central Excise, 2006 (2) Supreme 71: 2006 (198) ELT 485. In the general sense of the term, is that which is eaten or drunk for nourishment. It is a nutritive material taken into the body for the purpose of growth, repair or maintenance; that which is eaten or drunk for nourishment; whatever supplier nourishment to organic bodies. It is a general term application to all that is eaten for the nourishment of the body and includes that which is eaten or drunk for nourishment, any substance that is taken in the body which serves, though organic action, to build up normal structure or supply the waste of tissue, and includes confectionery, Word and Phrases (Permanent Edn., Vol. 17, p. 306).
