Sabyasachi Mukhjarji1. This is an appeal by special leave from the decision of the High Court of Allahabad in Sales Tax Reference No. 603 of 1971 under Section 11(5) of the U,P. Sales Tax Act, 1943 (hereinafter called the 'Act'). The question referred to the High Court under Section 11(5) of the Act was as follows: Whether, on the facts and in the circumstances of the case, the dealer could be declared non-taxable on sales of yarn for Rs. 8,70,810, which he made against III-A Forms though the purchaser instead of selling the said yarn in the same condition, consumed the same? 2. The division bench of the Allahabad High Court was of the opinion that the controversy raised in the reference was covered by the decision of the Full Bench of the said High Court in Commissioner, Sales Tax, Uttar Pradesh v. G.L. Oza, J.1. This appeal arises in peculiar circumstances. A complaint was filed in the Court of the Sub-Divisional Judicial Magistrate, Sahibganj on 26th April, 1974. The complainant claimed to be the son of one of the partners of the firm M/s. Dhanraj Sagarmal Tamakhuwala which owned a flour mill at Sahibganj. The allegations made in the complaint were of failure of power supply for four days to the flour mill and the Bihar State Electricity Board and other officers were joined as accused persons and it was also alleged that it resulted in monetary Joss to the flour mill. No particular act or omission of any particular officer or Board who were arrayed as accused persons was mentioned. We do not agree with the view of the High Court that the loan in question should have been advanced under the Act in order to attract the provisions of Sections 3 and 4 of the Bombay Relief Undertakings (Special Provisions) Act, 1958. The judgment of the learned Single Judge and of the Division Bench of the High Court are set aside and the case is remanded to the learned Single Judge to consider the submissions to be made on other points involved in this case. It is open to the Union which has filed Special Leave Petition No. 3428 of 1986 to apply to the High Court for being impleaded and the High Court on such application being made will consider it in accordance with law. Unfamiliar as I am with the history, tradition and the lore of the city and the High Court of Bombay, I content myself by agreeing with the conclusion of my learned brother that no appeal under Clause 15 of the Letters Patent lies to the High Court against the order of a single judge of the High Court exercising jurisdiction under Article 227 of the Constitution, no less and no more. I do not have any doubt that the reference to Section 107 of the Government of India Act, 1915 in Clause 15 of the Letters Patent must necessarily be read as a reference to Article 227 of the Constitution. So read an appeal under Clause 15 is clearly not maintainable against an order made in exercise of the power under Article 227. Capoor, who was previously Chief Secretary to the Government of Gujarat and against whom certain caustic observations had been made by the High Court of Gujarat, rather than for a decision on the merits of the case.
