The two appellants were tried before the Presidency Magistrate, 4th Court, Calcutta for offences under Section 120B read with Section 420 and Section 511 read with Section 420 of the Indian Penal Code. The learned Presidency Magistrate held them guilty of both the offences and imposed a sentence of 1 year's imprisonment and a fine of Rs. 200 on each of the accused on the first charge and considered that no separate sentence was necessary in respect of the second, and the appeals filed by them in the High Court of Calcutta were summarily dismissed. The facts giving rise to these appeals are as follows :2. Appellant Sudhir Kumar Mukherjee was an employee in charge of soda lime department of M/s. Gluconate Limited, Calcutta, and appellant Sham Lal Shaw was the supplier of lime stone to the said firm. It appears that four bags of lime stone were needed every day. A.N. 54 of 1970 were tried before the Additional Sessions Judge of Bhagalpur for offences under Sections 302 and 394 of the Indian Penal Code and convicted by him for both the offences. On a reference made by the Additional Sessions Judge for confirmation of the death sentence awarded to them and two appeals filed by them, the High Court of Patna upheld their conviction under Section 394 but acquitted them of the offence under Section 302. The accused as well as the State of Bihar have appealed to this Court, the former in respect of their conviction under Section 394 and the State against their acquittal in respect of the offence under Section 302. Kali Ram (40) was tried in the court of Sessions Judge Simla & Sirmur Districts for an offence under Section 302 Indian Penal Code for causing the death of Dhianu (60) and the latter's daughter Nanti (40). Charge was also framed against the accused under Section 392 read with Section 397 Indian Penal Code for having at the time of the occurrence committed robbery. The learned Sessions Judge convicted the accused under Section 302 Indian Penal Code and sentenced him to death. On appeal and reference, the High Court of Himachal Pradesh affirmed the conviction and the sentence of death. The accused thereafter came up to this Court in appeal by special leave.2. Five accused Ramanbhai Maneklal, Dhanji Venmalidas Jawansing Ukarasing, Virumai Mulchand and Chelaram Murajmal were tried in the court of the City Magistrate Ahmedabad, the first two for offences under Section 457 read with Section 380 Indian Penal Code and the last three for offences under Section 411 Indian Penal Code. The learned magistrate acquitted accused Nos. 1 to 3, while Virumal Mulchand accused No. 4 and Chelaram accused No. 5 were convicted under Section 411 Indian Penal Code and were sentenced to undergo rigorous imprisonment for a period of nine months and pay a fine of Rs. 200 or in default to undergo rigorous imprisonment for a further period of one month. Virumal and Chelaram went up in appeal, but their appeal was dismissed summarily by the Gujarat High Court. These two accused have now come up in appeal to this Court by special leave.2. Five accused Laxman (30), Suka Sukhdeo (40), Jyotiram (40), Rajeram (45) and Ramdas (28) were tried in the Court of' the Sessions Judge Amravati under Section 302 read with Section 34 Indian Penal Code for causing the death of Sitaram (40). Learned Sessions Judge acquitted Ramdas and convicted the other four accused under Section 325 read with Section 34 Indian Penal Code and sentenced each of them to undergo rigorous imprisonment for a period of three years and to pay a fine of Rs. 200 or in default to undergo rigorous imprisonment for a further period of three months. Two cross-appeals were filed against the judgment of the Sessions Judge. One of the appeals was by Rajeram against his conviction and sentence.
