This appeal, by special leave is, directed against the judgment and order dated 14/17 June, 1968 of the Calcutta High Court in Criminal Revision No. 475 of 1967 reversing the orders passed by the Court of the Chief Presidency Magistrate, Calcutta, discharging the accused-appellants.2. The circumstances leading up to the order of the High Court may be indicated: The second respondent filed a complaint on January 3, 1967 before the Court of the Chief Presidency Magistrate, Calcutta, in respect of the incident which took place on the second day (January 1, 1967) of the Second Cricket Test Match between India and West Indies at the Eden Gardens. The Test Match was to be played under the control, management and supervision of the Cricket Association of Bengal, which had sold tickets of various denominations for the game. The first is whether the transaction evidenced by Ex. 1, dated March 20, 1915 was a family arrangement so as to confer on the appellant and his father, Nanhku Prasad, since deceased, title to a half share in the house in dispute. The second is that even if it was so, whether such title became extinguished as a result of adverse possession for the statutory period by Baijnath, the deceased husband of respondent 1.2. V. Bhargava, J.1. The respondent, Gopal Chandra Khound, is the holder of a licence of a country liquor shop issued by the appellant, Sub-Divisional Officer and Collector, Shivasagar. The Superintendent of Excise of the Sibsagar Sub-Division, in which the shop of the respondent is situated, inspected some liquor shops in the month of June, 1965 and discovered that some of the bottles in the shops were not properly sealed. The covers could be turned all round without detaching them from the bottles and without breaking the seal. There could also be seepage from the covers if the bottles were turned up side down. He felt that this left a scope for tampering as well as deterioration in strength of the liquor in storage beyond the permissible limits; and, consequently, a few days later, on 24th June, 1965, he issued a letter to the Officer-in-Charge, Warehouses, Jorhat and Nazira; which were issuing the sealed bottles, to take all possible steps to secure the marked closures properly and to...

These appeals by special leave are from a common judgment of the Assam & Nagaland High Court and are directed against the orders made by that Court quashing the charges for alleged offences under certain provisions of the Indian Penal Code and the Prevention of Corruption Act, 1947. The fact may be stated, Lt. Col. G. K. Apte, the respondent in Cr.A. No. 164/68 was posted to Tejpur as Staff Officer No. 1 in the summer of the year 1960. It appears that a project known as the 'Tusker Project' had to carried out in the NEFA area The main duty of the units employed in the Project was the making of roads in the NEFA area to enable the movements of troops etc. in the event of any Chinese aggression. This appeal by special leave by the State of Madhya Pradesh is against the judgment of the High Court allowing the appeal of the respondents, Mir Basi Ali Khan, Mir Shahniwaz Ali Khan and Mir Sarfaraz Ali Khan, and setting aside the conviction and sentences passed on them by the learned First Additional Sessions Judge, Bhopal, who had convicted them under Section 120B and Section 420, I.P.C. The respondents were, however, acquitted of the charge under Section 406, I.P.C. We may mention that there were two committal orders made by the learned Magistrate, First Class, Bhopal, on April 5, 1965 and on October 12, 1965, respectively, which gave rise to two Sessions Trials, No. 90 of 1965 and No. 98 of 1965.
